DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, JULY 219 2003
Commissioners' Hearing Room - Administration Building - 1130 NW Harriman St., Bend
Present were Commissioners Dennis R. Luke and Michael M. Daly; Commissioner
Tom DeWolf was unable to attend due to illness. Also present were Mike Maier,
County Administrator; Susan Ross, Commissioners' Office; Mark Amberg, Legal
Counsel; Darwin Thurston, Bill Kopacz and Bill Sheridan of Midstate Electric
Cooperative; and attorney Aaron Courtney by conference call. No media
representatives or other citizens were in attendance.
The meeting began at 3:10 p.m.
Mike Maier stated that action needs to be taken as soon as possible regarding the
possible purchase of the Midstate Electric Cooperative facility in La Pine.
Evidently both parties thought that progress was being made, but little was being
addressed. The Sheriff needs to renew the lease on the Sheriffs Office's current
building, but does not know how long it should be extended.
At this time, three-ring binders were distributed to the Commissioners that
provided information on the history of the site, what needs to be done, and when.
Mr. Courtney, who was filling in for attorney Tom Lindley, said that phase 2 due
diligence should be conducted. Commissioner Luke asked that if there are some
Department of Environmental Quality sign -offs, should they be considered; and
what liability exists. Mr. Courtney replied that any liability would not be from the
DEQ but from the neighboring property owners. Midstate has owned the facility
for about fifty years. The adjoining wetlands area has been analyzed; however,
there is a risk that they were improperly filled.

Mark Amberg added that the Department of State Lands has jurisdiction regarding
filling, but there is always some risk regarding the provisions of the Clean Water
Act. Bill Sheridan said that the DSL signed off in July 1993.
Susan Ross stated that the original proposal from Midstate shows that a lot of work
has been completed, and the scope of the work plan could be reduced. Bill Kopacz
added that a big issue is that there is a ground source heat pump, and the pipes
need to be avoided if any digging is done. Mr. Courtney said that the County and
Midstate could work together on any required sampling.
Mike Maier reiterated that a move -in date is needed. The process boils down to a
few items that still should be addressed. Mr. Kopacz agreed that duplication
should be avoided. Mr. Courtney said that any red flags should be noted and
discussed.
Commissioner Luke observed that the Commissioners don't need to be involved in
this discussion; however, Commissioner Daly said that he would like to be present,
as he feels the DEQ sign -off is good enough. Ms. Ross stated that she would
coordinate a date and time for the meeting.
Being no further issues discussed, the meeting ended at 2: SS p.m.
