BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Ordinance Amending Title 17, the Deschutes
County Subdivision Ordinance, of the Deschutes * ORDINANCE NO. 2003-029
County Code, to Amend the Text of the Design
Standards for Lot Frontage, and Declaring an
Emergency.
WHEREAS, on July 9, 2003, the Deschutes County Board of Commissioners passed Ordinance 2003-
077, which allows for a 35 -foot lot width for detached zero -lot line single family lots in the La Pine
Neighborhood Planning Area, Residential Center District; and
WHEREAS, an oversight resulted in inconsistencies between the recently passed Ordinance 2003-077
and existing standards in Title 17 that need to be corrected; and
WHEREAS, after notice and hearing by the Planning Commission on August 28, 2003, as required by
law, the Board has considered the recommendation of the Planning Commission; and
WHEREAS, the Board of County Commissioners recognizes the urgency of this changes in order to
allow development of the Neighborhood Planning Area to commence; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS
as follows:
Section 1. AMENDMENT. DCC 17.36.180, Frontage, is amended to read as described in Exhibit
"A," attached hereto and by this reference incorporated herein, with new language underlined;
Section 2. FINDINGS. The Board of Commissioners adopts as its findings in support of this
amendment the Staff Report dated September 24, 2003, attached to Ordinance 2003-029 and incorporated by
referenced herein as Exhibit "C."

Section 3. EMERGENCY. This Ordinance being necessary for the immediate preservation of the
public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.

EXHIBIT "A"
17.36.180. Frontage.
A. Each lot or parcel shall abut upon a public road for at least 50 feet, except for lots or
parcels fronting on the bulb of a cul-de-sac, then the minimum frontage shall be 30 feet,
and except for partitions off of U.S. Forest Service or Bureau of Land Management
roads. In the La Pine Neighborhood Planning Area Residential Center District lot
widths may be less than 50 feet in width as specified in DCC 18 61 Table 2: La Pine
Neig=hborhood Planning Area ZoninL Standards
B. All side lot lines shall be at right angles to street lines or radial to curved streets
wherever practical.
