MINUTES OF SPECIAL MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
TUESDAY, OCTOBER 28, 2003
Commissioners' Meeting Room - Administration Building - 1130 NW Harriman St., Bend
Present were Commissioners Dennis R. Luke, Tom De Wolf and Michael M. Daly.
Also present were Mike Maier, County Administrator; Anna Johnson,
Commissioners' Office; and Mark Pilliod, Legal Counsel. Also in attendance were
Les Stiles, Sheriff; Sue Brewster and Jim Ross, Sheriffs Office; Marty Wynne,
Finance Department; and media representative Jason Carr of Z-21 TV.
The purpose of the meeting was to discuss how the upcoming Sheriffs levy issue
should be structured and presented to the citizens of Deschutes County. The
meeting began at 10:05 a.m.
Sheriff Stiles stated that he previously sent a memo to the Board with suggestions
on how the levy should be structured and which also detailed what he feels is the
appropriate rates, but has been told that politically it will never pass. He then
asked the Commissioners what rate they feel is best and what they think he should
cut from services.
Commissioner Luke voiced his concerns about the proposed rural rate, which he
feels is far too high. A discussion then took place regarding whether the levy
should be offered countywide, and the ramifications of failure of the passage of the
tax districts and/or levy.
Mike Maier said that there is a level of cost that the voters seem to be comfortable
with, although it is not adequate to maintain services. In fact, the Sheriffs Office
has had to use up reserves to keep the current level of services in place, so a higher
rate would be necessary. He asked what kind of increase might be needed to
maintain existing services.

Commissioner Luke stated that there should be some way to determine the cost per
deputy, including support staff, vehicles and other equipment, maintenance, and so
on.
Commissioner DeWolf suggested that the members of the group adjust their way
of thinking. With the requested high rural rate, if it fails the deputies could lose
their jobs. In his opinion, there shouldn't be something on the ballot that will
likely fail. He said he has never had to have a fire truck visit his home, but he pays
for that service; and he no longer has children in school, but pays for the schools.
Having adequate public safety services in the area is something that all taxpayers
should be willing to support as a part of the infrastructure of the area. He has
recently met with Marty Wynne to talk about a different way of looking at the
situation.
Sheriff Stiles indicated that he has promised citizens that they should only have to
pay for what they actually receive, and it is his philosophy that citizens living
outside of the cities should pay more. The Commissioners pointed out that the
services provided by the Sheriffs Office do not end at the city limits. They added
that there are many city dwellers that go outside of the city limits for work,
recreation and other reasons, and expect to be helped by the Sheriffs Office if they
need it. The Commissioners expressed concern regarding what they feel is the
disproportionate increase for rural citizens.
Commissioner Luke added that public safety is a system of courts and law
enforcement. Cooperation is much better now than it has been in the past, and this
partnership would be threatened when one part is out of balance.
At this time Marty Wynne discussed some ideas he had about how to structure the
levy in a fashion that could be acceptable to the voters. (A copy of his information
is attached as Exhibit A.)
Sheriff Stiles indicated that he still needs to talk with some of the cities'
councilors, but his main concern is what the citizens want. In his opinion citizens
want to pay for only what they receive. Commissioner DeWolf stressed that voters
need to be educated on what the system provides and why the services cannot be
separated so easily.

Commissioner Daly said that in his opinion there's no chance that the proposed
high rural rate will pass, and that a total concept needs to be sold to the citizens.
Marty Wynne added that 33 of the 36 counties do not charge a higher rate to
citizens living outside of the city limits; it is understood that a system of law
enforcement benefits, and needs to be supported by, all citizens.
It was suggested that the Sheriff go for a simple five-year levy to buy some time;
especially since the split rate has already been adopted repeatedly. This could
possibly result in maintaining the current level of service, provided the maximum
rate is used. It was also suggested that the work center be placed on the ballot
separately so that the need for it can be sold to the citizens. It would be an
alternative to having to matrix out prisoners from the jail.
After a lively discussion, those at the meeting did agree on a few points: that time
is getting short for getting something on the ballot, and a decision has to be made
soon; and that there needs to be a meeting of the minds, because it is imperative to
present a united front to the voters or nothing will pass. The group will meet again
as soon as possible to consider the various options and to perhaps come to an
agreement as to how to proceed.
Being no further discussion offered, the meeting ended at 11:50 a.m.
