2003-1468-Resolution No. 2003-133 Recorded 12/17/2003REVIEWED LEGAL COUNSEL COUNTY OFFICIAL NANCYUTES BLANKENSHIP, COUNTY CLERKDS �J ZO��-1468 COMMISSIONERS' JOURNAL IIIIIIIIIIII 1111111111111111111111111 2003-1468 19/11/1403 04;16;21 PM For Recording Stamp Unly BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Adopting an Annual Adjustment to the System Development Charges for Transportation and Parks Within the Urban Growth Boundary and Outside the City Limits of the City of Redmond as authorized under Section 4 of Resolution 2001-036 * RESOLUTION NO. 2003-133 WHEREAS, the intergovernmental agreement dated June 23, 1998 between Deschutes County and the City of Redmond provide for joint management within the City of Redmond Urban Growth Boundary, Redmond Growth Area and Redmond Area of Mutual Interest; WHEREAS, Deschutes County Code Chapter 15.12 and ORS 223.297 to 223.314 provide for the establishment of system development charges (SDCs) by resolution; WHEREAS, Deschutes County previously adopted Resolution No. 2001-036 which adopted a new SDC methodology and new fees as well as a Capital Improvement List for Transportation and Parks within the Urban Growth Boundary and outside the City limits and allows for the annual adjustment of SDCs based on the Engineering News Record Construction Cost Index; WHEREAS, Deschutes County previously adopted Resolution No. 2002-093 which adopted the Engineering News Record Index as the basis for annual adjustments to SDCs and adopted a new Capital Improvement List for Transportation and Parks within the Urban Growth Boundary and outside the City limits; WHEREAS, the City Council for the City of Redmond periodically reviews the existing SDC fee and Capital Improvement Plan ("CIP") as authorized by state law; WHEREAS, the City Council, based on the recommendations from Redmond staff, adopted Resolution No. 2003-46 adjusting the SDCs to reflect annual increases in the Construction Cost Index published by the Engineering News -Record; WHEREAS, pursuant to the intergovernmental agreement between the City of Redmond and Deschutes County signed in 1983, approval of the adjusted SDCs for transportation and parks in the unincorporated Redmond Urban Growth Boundary also requires approval by the Deschutes County Board of Commissioners; PACE 1 OF 2 — RESOLUTION NO. 2003-133 (12/1/03) S:\LEGAL\BOCC RESOLUTIONS\2003\RES 2003-133 REDMOND TRANSPORTATION AND PARKS SDCS.DOC WHEREAS, on December 3, 2003, the Board provided an opportunity for comment on the proposed fees consistent with ORS 294.160(1); now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. PURPOSE. This resolution adopts the annual adjustments and changes to the SDCs for transportation and parks for the area within the unincorporated area of the City of Redmond Urban Growth Boundary. Section 2. ANNUAL COST ADJUSTMENT. The County hereby modifies the SDCs for development for transportation and parks, as follows: Exhibit A: Transportation SDC (2003): $2,558.00 per PM peak hour trip Exhibit B: Parks SDC (2003): $742.00 per EDU Section 3.
