REVIE D tl EGALCOUNSEL' DESCHUTES COUNTY CLERK Vu 1.������� NANCY COMMISSIONERS' JOURNAL �'N'�'�'"°'� For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Approving the La Pine Rural Fire Protection District's Adoption of Amendments to said District's Ordinance 99-001. * * RESOLUTION NO. 2004-023 * * WHEREAS, the La Pine Rural Fire Protection District (the District) has adopted pursuant to ORS 478.910, a fire protection code based on the 1998 Oregon Uniform Fire Code, as Ordinance 99- 001; and WHEREAS, the District has, pursuant to ORS 478.910, amended Ordinance 99-001 as Ordinance Nos. 2004-01 and 2004-02; and WHEREAS, in accordance with ORS 478.924, the District has submitted Ordinance Nos. 2004-01 and 2004-02 to the Board of County Commissioners of Deschutes County for approval; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That La Pine Rural Fire Protection District Ordinance Nos.2004-01 and 2004-02, attached hereto as Exhibits A and B, are hereby approved. DATED this 22nd of March, 2004. I TOM DEWOLF, Commissioner La Pine Rural Fire Protection District Ordinance No. 2004-01 AN ORDINANCE AMENDING LA PINE RURAL FIRE PROTECTION DISTRICT ORDINANCE 99-01 ADOPTING THE OREGON UNIFORM FIRE CODE FOR LA PINE RURAL FIRE PROTECTION DISTIRCT AND PRESCRIBING REGULATIONS TO GOVERN CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION; AND OTHER PERTINANT PROVISIONS. WHEREAS, the Board of Directors, hereinafter referred to in this ordinance as "Board" of La Pine Rural Fire Protection District, hereinafter referred to in this ordinance as "District," having previously adopted Ordinance No. 99-01, adopting the Oregon Uniform Fire Code, 1998 edition, for the District; WHEREAS, after investigation and consideration, the Board desires to adopt portions of Section 1102 of the Oregon Uniform Fire Code, 1998 edition, which were not previously adopted by Ordinance No. 99-01; WHEREAS, after investigation and consideration, the Board desires to replace Appendix H -K of Ordinance No. 99-01 containing the District Burning Ordinance as it pertains to burning permits and enforcement of violations of the Burning Ordinance; and WHEREAS, after investigation and consideration, the Board desires to replace Section 10 of Ordinance No. 99-01; Now, Therefore: THE BOARD OF DIRECTORS OF THE LA PINE RURAL FIRE PROTECTION DISTIRCT, ORDAIN AS FOLLOWS: SECTION 1. ADOPTION OF SECTION 1102 The following parts of SECTION 1102 — pertaining to OPEN BURNING, Sections 1102.3 through 1102.4.5, are hereby adopted and added to the Oregon Uniform Fire Code, 1998 Edition, as adopted by the District. SECTION 2. REPLACEMENT OF APPENDIX R -K. Appendix H -K of La Pine Rural Fire Protection District Ordinance 99-01 is hereby replaced in its entirety with Appendix H -K of the Oregon Uniform Fire Code, 1998 edition. SECTION 3. REPLACEMENT OF SECTION 10 OF ORDINANCE 99-01. Section 10 of Ordinance 99-01 is amended in its entirety to read as follows: La Pine RFPD Ordinance 2004-01 1 Exhibit Page / of o� "SECTION 10. PENALTIES Pursuant to ORS 478.990, each violation of the provisions of this Code is a Class D violation. A Class D violation is punishable upon conviction by a fine of $75.00 for each offense. Each day's continued refusal to remove a fire hazard after notice by the inspecting officer shall constitute a separate offense and shall continue to accrue each day until the fire hazard noted by the inspecting officer is removed. Failure to comply with multiple sections of any outdoor burning regulations published by the District shall constitute a separate violation for each section violated. Violations shall be prosecuted in the Justice Court, pursuant to ORS 478.990(4), located in the City of La Pine, Oregon." SECTION 4. DATE OF EFFECT. This ordinance shall take effect and be in full force and effect the 301' day following its adoption by the governing body. WHEREAS, the Board of Directors, hereinafter referred to in this ordinance as "Board" of La Pine Rural Fire Protection District, hereinafter referred to in this ordinance as "District," having previously adopted Ordinance No. 2004-01, amending provisions of the Oregon Uniform Fire Code, 1998 edition, for the District; and WHEREAS, amendments to ORS Ch. 478 have rendered inaccurate certain citations within Ordinance No. 2004-01; and WHEREAS, after investigation and consideration, the Board desires to make technical corrections to Section 10 of Ordinance No. 99-01, as amended by Ordinance No. 2004- 01; Now, Therefore: THE BOARD OF DIRECTORS OF THE LA PINE RURAL FIRE PROTECTION DISTIRCT, ORDAINS AS FOLLOWS: SECTION 1. CORRECTION OF SECTION 3 OF ORDINANCE No. 2004-01. Section 3 of Ordinance No. 2004-01 is amended in its entirety to read as follows: "SECTION 10.
