DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, APRIL 7, 2004
Commissioners' Hearing Room - Administration Building

The meeting began with a lively musical presentation given by the Lava Ridge
Elementary Choir (over 200 third and fourth grade students).
Present were Commissioners Dennis R. Luke and Michael M. Daly; Commissioner
Tom DeWolf was out of the office except to address an addition to the agenda via
conference call. Also present were Timm Schimke, Solid Waste Department; Tom
Blust and Gary Judd, Road Department; Laurie Craghead and Mark Pilliod, Legal
Counsel; and Marty Wynne, Finance Department.
Also in attendance were Gary Smith, Mental Health Department; Tammy
Credicott, Property Management; Dave Peterson, Information Technology
Department; Mike Maier, County Administrator; and Nancy Blankenship, Clerk;
approximately twenty other County employees; media representative Barney
Lerten of bend. com and The Bugle; and over 200 other citizens, including students
Chair Michael Daly introduced teacher Ellen Logan and her third and fourth
grade students at 10:05 a.m., at which time they performed for the audience.
The regular meeting began at 10:30 a.m.
1. Before the Board was Citizen Input.
GRETCHEN GRIVEL:
I want to make a comment regarding how the County would feel about posting
notifications at the landfill, like an architects rendering of what will be going on
there.

TIMM SCHIMKE:
There are foam boards in the office that have renderings and conceptions.
GRIVEL:
Can you move the signage to the actual entry to the landfill?
LAURIE CRAGHEAD:
This needs to be discussed off the record.
LUKE:
There is a pending land use action. A sign is posted at the site; it's not huge, but
it is what is required. Timm has architect renderings in his office conference
room that anyone can view during normal working hours.
GRIVEL:
Downtown at Wall and Greenwood, there's a big sign. The County should do
that kind of thing, too.
LUKE:
That kind of signage is very expensive.
Because of ex parte contact, the Board is not allowed to talk about the project,
and this needs to be discussed outside of the presence of the Board.
LUKE:
You are represented by legal counsel, correct? Your counsel needs to give you
permission to discuss this with County legal counsel.
2. Before the Board was the Reading of a Proclamation Declaring April 16
through 18 National Youth Service Days in Deschutes County.
Jenny Scanlon gave an overview of the projects to be addressed during Youth
Service Days. Commissioner Luke stated that a, percentage of children end up
in the corrections system, and these kinds of programs are important in keeping
that number as small as possible.

Ms. Scanlon stated that most don't end up in the system, and of those who do,
85% of them do not come back into the system. She added that it is
disheartening to look at the budget cuts from the State in various programs that
connect kids to their communities and keep them out of trouble.
She said this is the first year her department is celebrating this national event.
Over fifty local youth will be participating in various services to the
community. She added that there will be a ceremony on April 16 at which the
keys to a new Habitat for Humanity house will be passed on to the new owners.
At this time, she read the Proclamation to the audience.

3. Before the Board was the Reading of a Proclamation Declaring April 18
through 24 Crime Victims' Rights Week in Deschutes County.
Jenny Scanlon explained that her department values the victims of crimes, and a
big part of the department's programs involves restitution to victims and the
involvement of victims as much as possible.
LUKE: Move approval, and ask that Commissioner DeWolf be allowed to
sign as well.

4. Before the Board was Consideration of Signature of Document No. 2004-
144, Acknowledging the Assignment to the Lender of the Developer's
Contingent Interest in Trust Account Funds Held by the County for
Required Improvements to Pronghorn Destination Resort.
Laurie Craghead gave a brief overview of the document, which is now in its
final form.

5. Before the Board was Consideration of Signature of Letters Appointing
James Kerfoot and Jim Keller to the Deschutes County Audit Committee,
through April 6, 2006.
David Givans explained that the Board felt there should be increased input from
the public; County employees Mike Maier and Marty Wynne will now act in an
advisory capacity only.
Mike Maier stated that the two new members are outstanding candidates. Jim
Kerfoot is a retired finance director from the City of Bend, and Jim Keller
previously worked as a city manager for Klamath Falls and Gresham.

12. ADDITIONS TO THE AGENDA
A. Before the Board was Consideration of Signature of Document No. 2004-
152, Consent to Annexation Forms regarding the Transfer of Property to
the City of Redmond.
Commissioner Luke gave an overview of the item for the benefit of the
audience.

Chuck McGraw of the City of Redmond stated for the record that he
understands George Read, the Director of Community Development, recently
had heart surgery, and wanted to express his wishes for a quick recovery.
B. Before the Board was Consideration of Signature of Order No. 2004-033,
Correcting a Scrivener's Error in Order No. 2004-025, regarding the
Creation of Oasis Local Improvement District.
Gary Judd said that this Order corrects the cost estimate approved last week; the
amount should have been slightly less.

C. Before the Board was Consideration of Signature of Document No. 2004-
151, a Memorandum of Understanding between Deschutes County and
Bend Police Department regarding Use of the County's Records
Management System.
Commissioner DeWolf joined the meeting at this time via conference call. He
pointed out that this has been in the works for a long time, and a lot of effort has
been put into it. He said that 9-1-1 had battled to get all of the local law
enforcement agencies on the same program for years.
When Les Stiles was elected Sheriff, all agencies except the City of Bend began
using the same system. Now Bend is joining as well. This is very important for
public safety in Deschutes County. When Bend was on a separate system, their
officers could make a traffic stop and not know that the City of Redmond or the
County had an outstanding warrant on the individual.
Dave Peterson added this is an interim agreement, and that the goal is for other
cities, counties and the State to participate.

D. Before the Board was Consideration of Document No. 2004-149, an
Intergovernmental Agreement between Deschutes County and the
Accountable Behavioral Health Alliance for the County to Provide
Financial Consulting Services.
Marty Wynne explained that ABHA is a five -county health alliance, consisting
of Benton, Lincoln, Jefferson, Crook and Deschutes counties, which provides
mental health services through an intergovernmental agreement. They accept
and distribute state funds for better utilization of those funds.
He added that ABHA has used an outside private firm for financial reporting
and budget preparation. This agreement allows Deschutes County to provide
those services, which will save approximately $17,000 per year.
Gary Smith explained his concerns about Oregon Health Plan dollars going
away; this would threaten the existence and work of this group. It is hoped that
the State Emergency Board will consider continuing funding these services.

E. Before the Board was a Discussion regarding ATV Damage to Properties
along the Little Deschutes River Corridor.
Commissioner Luke said that a complaint has been received about ATV riders
damaging properties along the Little Deschutes River in the southern part of the
County.
Tammy Credicott stated that she spoke with this property owner and is now
gathering information. The area consists of different zoning: floodlands,
wetlands, and a wildlife combining zone. She spoke with a representative of
the Division of State Lands as well. She has not had a chance to view the
property but will do so soon, to see the extent of the damage.

She stated that the best recommendation is to post the property as "no
motorized vehicles" because of the wetlands. Enforcement is an issue,
however. The County owns quite a few properties in the area, including many
that are not buildable. (She then showed a map of the area and properties to the
Commissioners.)
She added that if the offenders take their ATV's onto posted land, they would
be trespassing, a violation of County Code. County property at Byram Road
was previously posted in this manner.
Commissioner Luke stated that he voted against posting the Byram Road
property because he feels public properties should not be closed to the public.
However, that is a large parcel of land; the properties off the Little Deschutes
River are small properties that are being overrun and destroyed.
He added that the Road Department will help with making and posting the
signs. He stated that he had spoken with Larry Blanton and Ken Jones of the
Sheriffs Office, and they indicated that even if the property isn't in a wildlife
overlay zone, people still can't abuse the property. And most members of local
ATV clubs would condemn the actions of the people who are doing this
damage.
Ms. Credicott advised that the neighbors have tried to work with the offenders,
but have been unable to get anywhere with them.
Commissioner Daly asked that photos of the damage be provided at the Board
meeting of Wednesday, April 14. Mike Maier asked that a briefing of the
Habitat for Humanity property in that area also be discussed at that time.
Being no further items brought before the Board, the meeting adjourned at
11:25 a.m.
