Daly, Tom De Wolf and Dennis R. Luke. Also present were Gary Judd, Dennis Morris and Tom Blust, Road Department; Scott Johnson and Angela Curtis, Commission on Children & Families; Mike Maier, County Administrator; Timm Schimke, Solid Waste Department; approximately thirty students (including a group of home schooled students); and media representatives Barney Lerten of bend. com and The Bugle, and Chris Barker of the Bulletin. Chair Mike Daly opened the meeting at 10: 00 a.m. 1. Before the Board was Citizen Input. JULIE EBERHARD-WEAVER: (Ms. Eberhard-Weaver read a prepared statement.) Today we are presenting 590 signatures of people who are opposed to siting a tire pyrolysis project at the Knott Landfill. (A copy is attached as Exhibit B.) We did not have to work very hard to gather these signatures, and it is apparent that a lot of people do not want this project placed so close to a school and homes. We could easily gather more signatures in the coming weeks. We are concerned about the location of this project. It is not proven to be safe near children. We recently learned that this particular machine was invented in 1992, hasn't been on the market for twelve years, and according to the inventor, no longer meets environmental standards in England. Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 1 of 12 Pages The emissions data is still not here, and we are not convinced that even if the emissions are considered somewhat low by industrial standards, that it is acceptable near a school. On top of emissions concerns, machines malfunction, parts wear out, and we do not know what the training or the experience of the operators of this machine will be. The Rubber Manufacturers Association does not recommend tire pyrolysis as a viable option for dealing with scrap tires. Jerry Powell, editor of Resource Recycling, a recycling magazine out of Portland, e-mailed me this yesterday. "Tire pyrolysis has been a dismal failure. Tires can be broken down in heated chambers in the absence of oxygen. The steel from such systems is fully recyclable and some gasses can be captured for use in operating the system. However, the history of pyrolysis shows that efforts to capture other forms of energy and oil have been very problematic, and the so-called carbon black is essentially worthless. Millions of dollars of private investment money has been lost in hundreds of pyrolysis projects through the years. I remain a skeptic mainly because I am aware of the sophisticated chemistry contained in a tire. It is a marvel of technological development." Michael Blumenthal, senior technical director to the Rubber Manufacturers Association has said, "Have there been pyrolytic operations permitted and operated in the United States? Yes, there have been several. However, none were operated on a commercially viable basis, and all closed in a matter of months. There are no successful commercial pyrolysis operations occurring anywhere in the world." We are concerned about West Nile virus if the landfill is permitted to store 12,000 tires. In brochures at the Deschutes County Planning Division, we are advised to not keep any old tires in our yards, to help prevent against West Nile virus; 12,000 tires could hold thousands of gallons of standing water. And the ravens and crows that frequent the landfill could be potential vectors for this disease. We are concerned about the carbon char that results from this process, and the fact that up to 1,000 tons will be buried in Knott landfill, according to IRR, as they do not have a market for this end product. Carbon char contains ash as well as carbon black. We have learned that carbon black is hazardous upon inhalation and can be carcinogenic. It does not seem to be prudent to place hazardous substances in our landfill when tires can be recycled in different, proven ways. Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 2 of 12 Pages Michael Blumenthal has said, in Oregon scrap tires are used as a tire-derived fuel in cement kilns; ground rubber, finely processed particles of rubber, are used by several companies to manufacture new products like roads or playground surfaces. Finally, tires are shredded and used in civil engineering applications. Tires are used in lieu of conventional construction materials like sand, dust, etc. "In the case of Bend, Oregon, I would suggest civil engineering applications - such as tire shreds used in landfill construction - as reasonable and viable use of the tires available in your area", said Michael Blumenthal. I am thankful that Deschutes County is concerned about recycling. I am a supporter of recycling efforts, and I weekly fill my plastic bins with recyclable materials. I agree that we should strive to find ways to recycle and reuse tires. Tire pyrolysis is not a recommended manner for recycling tires, according to experts in the fields of scrap tires and recycling. And a project such as this should definitely not be placed so near High Desert Middle School, or any school. The school district and the staff of the school, and parent, have expressed concerns about this project, as well as the residents of Deschutes County. Thank you very much. I hope you will end this project and begin looking at other options for recycling tires. DEWOLF: After I called you, Julie, I called and talked with Mr. Beven in England last week. The one thing that I'd be - you know, there have been some very good questions raised about this process. But I think it is unfair to characterize the machine as not fitting England's standards. It makes it sound like this is the death machine or something. The reality is, he said you need to make two minor tweaks for this machine, on the top and bottom, to capture any potential emissions. And that's all that needed to be done. And he said this is a terrific machine, and if run properly with trained operators, it would be magnificent. He said the steel that comes out of it he was getting 95 pounds a ton when most scrap steel gets 5 pounds a ton in England. One of the components of the oil is used as a base for cosmetics, and he said it is really quite valuable. He is a strong supporter; obviously, he created the thing and it carries his name. Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 3 of 12 Pages If this doesn't come here, and it well not, it is going to go somewhere. They're talking with people in Arizona, people in Russia and Sweden about siting this. And I believe at some point this process will be accepted. I asked him what I need to be concerned about; the operators? Has the machine been refurbished properly because it hasn't been used in a long time? These are all good questions that we need to ask. The reality is, what you're talking about recycling tires, if all of that were being done we wouldn't have the situation in Prineville that we have right now. EBERHARD-WHEELER: Spoke off the microphone. Unintelligible. DEWOLF: I'm just suggesting that there have been some good questions asked, and I appreciate you being calm and reasonable about this. I have not been pleased with some of the actions of a few folks. You giving me that phone number was very helpful. I felt it was a very necessary conversation for me to have with the inventor of this machine. I want you to know that I believe we are following up and doing our due diligence as we decide where we're going with this process. Thanks. DALY: I have a couple of comments. This tire pyrolysis project might be the best thing since Betty Crocker cake mixes. I don't have any question that it is technology that we do need. But I realized early on that our neighbors don't want it in this county, and don't want it by the landfill. And I have to respect that. I just think that this one little issue has no long-term benefit for Deschutes County, and it has practically destroyed all of the good relationships that Timm has worked so hard to build around the landfill over the years. I recognized early on here that this is something that we don't need to follow up on. I certainly would like to see this thing go away. DEWOLF: I appreciate that, Mike. But I feel like our responsibility in the positions that we hold, which are positions of trust, and there are people who are upset that we would even consider something like this, I find difficult to understand. We are willing to consider a lot of things to deal with problems and challenges, like tires. Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 4 of 12 Pages We set up a process, and we've been working for two years off and on, and Timm has been working with these folks, that we owe it to them to finish this thing out. It may well be that this does not go forward. We don't have a signed lease, and you and I voted to put that old. So there's nothing that obligates us to move forward with this. DEQ is now going to reschedule that hearing. I just don't have a problem with continuing and concluding the process we began. I think it is a decent process, and has taught certain individuals how to get involved in their community in ways that they maybe never wanted to. I'm okay with allowing the process to continue. IZZY OREN: I'd like to bring something up for the record. Number one, I hope that you don't have the impression that there are only fifty or sixty of us against it. There are way many more people that are against it, but they can't attend the meetings or don't have the time. Some of them are just too busy to get involved. That's why you see the fifty or sixty people who show up at the meetings. The other issue is, I think you should anticipate strong opposition from the PTA. Because right now they are starting to get involved. That is going to create a tremendous pressure on the school district. I can almost guarantee that if the tire pyrolysis goes on, those kids are going to be held back from that school. That's going to create another problem. The final thing is, and I don't know if this question has been asked the way I'm going to ask it now. If this is really that good, how come it was rejected, and nobody else has it, and why should we be the first to try it? Why shouldn't we let some other place try it, and if it's good, then let's bring it here, too. But we'll know it is safe because it has been tried elsewhere. I don't think we need our name on the record that we're the first one. DEWOLF: Izzy, that may well be where this ends up. It won't surprise me a bit for IRR to pull up stakes. There are other people who are making offers for them to come to their communities. And that may well be. I'm fine with that conclusion. Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 5 of 12 Pages I've learned more about tire pyrolysis than I ever imagined learning about a subject like this in my life. And I find it valuable, because if it does come back two years from now, with modifications or proof that it works great, we'll have that history behind us. This is a community that will have a great deal of knowledge about this technology, and I think that's valuable. It's a valuable exercise, and it's valuable to have this knowledge about this potential recycling process. OREN: I don't disagree with that. The only problem is, I don't know if you heard about Beverly Hills High School where there's an oil pump at the high school, like many other places in southern California. They found out a few years later that some of the kids there developed leukemia. This seems to be very sealed and just pumping forty gallons a day or whatever. I don't have a kid there, but how are we going to feel if something happens when they open those vats to clean, when we don't know what is going to come out of there. The other issue is the storage of the tires there. I'm sure you're aware of what happens with a fire that could ignite 12,000 tires. Our fire department couldn't put it out. Dennis, you told us that Timm said they could throw dirt on it and put it out. There's no way you can do that. If you ask the fire department - LUKE: We have asked the fire department. There was an e-mail that came quoting Gary Marshall inaccurately. I sent it to him and he responded that it was an inaccurate quote, and what they were saying is incorrect. The fire can be put out. I'd be happy to share that e-mail with you. OREN: And I'll share the information on the Los Angeles Fire Department with you. The fire burned for thirty-four days. My question is, if you lived right next to it, would you also vote the same way? LUKE: I would. Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 6 of 12 Pages DEWOLF: The thing that was interesting to me, in the midst of all this is this big story about kids that are dealing with the fumes from the school buses. What Mr. Beven said in England is that this is what is coming out of the machine. The same as the exhaust pipe of a bus. These are taking kids all over. OREN: Why would we want to add something, if there is already enough? I heard another quote about the stuff, the emissions from the schools and the cars. But this is a necessity. We can live without the tire pyrolysis. I appreciate your time. GRETCHEN GRIVEL: I just wanted to know how it was concluded that we should grant an expansion to this landfill based on all of the code violations that are going on currently. I overheard Tom say something to Izzy a bit ago about trying to plant grass there to cover up a landfill and the grass wouldn't grow. What was that about? DEWOLF: That was a completely separate issue with the Rose pit, a different property. GRIVEL: That's what I'm talking about. The landfill in general. DEWOLF: This is across the street. GRIVEL: So, they tried to plant grass on it as reclamation, and the grass wouldn't grow? DEWOLF: I don't have enough information to discuss that. Izzy was just concerned about code enforcement. GRIVEL: I'm concerned about code enforcement, too. And I live kind of due east of the landfill, and get a lot of plastic bags and dust. I'm just curious why, with all of these current violations that are going on, it was agreed to go ahead and expand that landfill another seventy acres. And that's a 350 acre parcel back there, is that correct? Minutes of Board of Commissioners' Work Session Monday, April 5, 2004 Page 7 of 12 Pages DEWOLF: Laurie, I need to ask you a question, please. And I don't mean any offense. Is there a lawsuit pending? LAURIE CRAGHEAD: We haven't gotten notice of a lawsuit yet. My understanding is that there is a possibility of an appeal of the conditional use permit to the Land Use Board of Appeals. If you are going to be talking about the site plan, that is a quasi- judicial decision, and could come before you as an appeal, so you could be stepping over the bounds of ex parte contact. DEWOLF: Okay, so we can't really talk about this. GRIVEL: You can't talk about the code violations at the landfill? DEWOLF: I don't believe there are any. I can't do that. CRAGHEAD: Code violations are a separate issue, unless it leads into your deliberations on a possible decision on the site plan issue. GRIVEL: I think it definitely does speak to it. CRAGHEAD: Then it would need to be done at a public hearing, if there is one. It is an administrative decision now, unless it is appealed to a Hearings Officer, and if that is appealed, it would come to you. GRIVEL: I didn't submit comments at the hearing because I wasn't notified. And I am within the 750 feet. You'll have to bring that up at the site plan approval level. No other citizen input was offered. 2.
