John Andersen, Planning Director, gave a brief back-

MOTION: TUTTLE moved for adoption of ordinance 83-
037.
PRANTE: Second.
Chairman Young stated that he was in opposition to
these ordinances because they would provide another
tool for restricting development, because it could
create opposition between neighbors, it would further
limit property rights, and property titles could be
clouded. He also commented on frauds associated with
solar distributors, and felt that these ordinances
would serve to protect them. He stated that energy
conservation would not lower the cost of energy, but
make the cost per unit higher because the power
companies are allowed the same amount of income even
if they provide less power. He asked that these
ordinances not be adopted for these reasons.
Commissioner Tuttle stated that he was in favor of the
ordinances and that the primary intent of the ordin-
ances is to protect property owners' access to sun-
light and this would enhance and protect values. He
stated that the adoption of these ordinances would
help to fulfill a pre-existing commitment to solar

11 access in the Comprehensive Plan and they are
consistent with the Northwest Power Plan and the
Northwest Power Planning Council. He stated that they
would protect people from higher energy costs.
Commissioner Prante also stated her support of the
ordinances, saying that it was important not to
confuse the issue of solar legislation with instances
of unethical conduct in the solar industry.

Plan Review Jay Langley, Supervising Sanitarian, stated that this
Agreement with is the signing of the contract negotiated with the
State Health previous Board. The work has been completed by the
Division County, and the signature of the contract will
facilitate payment to the County by the State in the
amount of $2500.
MOTION: TUTTLE moved to sign the agreement with the
State Health Division.

Decl&ration of Neil Hudson, Director of Public Works, explained that
Dedications/ the Vetterliens own the ranch bordering the Fryrear
Vetterlien/ Landfill road. The road's actual course is not on the
Deschutes Co. platted road, so these declarations of dedication
correct that.
MOTION: TUTTLE moved to accept the declaration of
Vetterlien to Deschutes County and approve
the dedication of Deschutes County to the
public.
