46-144-Minutes for Meeting November 06,1974 Recorded 11/6/19741 ~R r IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES Court Day Minutes November 6, 1974 Commission Hearing Room Courthouse Annex Attendance: Commissioners, Albert Young, Bill Schinkel, and Joe Peden, Charles L. Plummer, Dave Hoerning, Robert A. Herwick, Theo B. Herwick, Patti R. Nielsen, Louise A. Demmick, Jerrold G. Matheny, Paul T. Erb, Jane L. Bates, Robert C. Slawson, Sheridan A. Athinson, Jan Wick and Sheridan Fahnestock from the Bulletin. Chairman Young called the meeting to order at 10:00 am. First item on the agenda was the Final Hearing on Annexation to Rural Fire Protection Dist. #2. There being no objections, a motion was made, seconded and carried approving Annexation to Rural Fire Protection Dist. #2. Next item on the agenda was the Final Hearing on Land Exchange with Central Oregon Irrigation Dist. Mr. Robert Herwick presented the Commission with a petition signed by home owners adjoining the property to be exchanged to C01, objecting to proposed soil and gravel removal by C01. Mr. Paul Erb, original owner of the property is in favor of the exchange so that a clear title can be given to the present owner Jerrold G. Matheny. He has a five acre parcel in the same area he would sell to the County to exchange with C01 as an alternative approach. Joe Peden mentioned that the property in question has been zoned for dirt removal and whether it belongs to the County of C01 will not stop dirt being removed from the property. The property owners present at the hearing claim they were never notified by the Planning Commission that a zone change was being made. Lorin Morgan explained the legal procedure required by law for giving notice to property owners concerning zone changes. Jane Bates questioned that when a Hearing is being held that effects residents in the Redmond area why the Hearing Notice is published in the Bulletin instead of the Spokesman. Mr. Young explained that the law requires that a County publish in a paper of general circulation in the County and that the Bulletin meets this requirement. Due to the objections over this land exchange with C01, Joe Peden made a motion to continue this Hearing to a future date giving the Commission time to negotiate further with C01 in regard to other sites for this exchange. Motion was seconded by Bill Schinkel and passed. At this time the Commission signed Orders establishing Florence Drive and Park Way as Roads. The Commission accepted the Resignation of Jack L. Broadley from the Special Road District No. I and appointed Frank Milby to his unexpired term. YOL 46 °AcE I45 Court Day Minutes Cont'd Page 2 Jan Wick presented a Development Agreement to the County for solid waste disposal at the Dicalite Site. This matter was taken under advisement. Dave Hoerning presented Resolutions to establish Martee Lane, Carolyn Court, Byram Court and Wallace Road as county roads. Final Hearing date has been set as Dec. 18, 1974. Mr. Robert C. Slawson, representing Deschutes County Senior Citizens petitioned the Commission for reduced rates for Flu Shots for Senior Citizens. He was told the County would look into the possibility of setting up such a program. Upon the Petition of James S. Drew for a Way of Necessity for access to his property, the Commission ordered a Board of Review be appointed made up of Charles Plummer, Harvey Watt and Jack Robinson. They will meet on Nov. 26, 1974 to view and locate a suitable ingress and egress to the property as petitioned by James Drew. The Board of Reviewers will report to the Commission at their regular session on Dec. 4, 1974. There being no further business, meeting was adjourned. BOARD OF COMMISSIONERS COMMISSIONER
