CLERK ORDER NO. 83-062 WHEREAS, a petition requesting a vacation of a portion of Pringle Falls Road, was filed with the Board of County Commis- sioners of Deschutes County, Oregon, in April of 1981; and WHEREAS, the Board of--County Commissioners declared its intent to vacate said Road by Resolution No. 82-065, dated November 24, 1982; and and WHEREAS, notice of hearing was given in accordance with law; WHEREAS, a hearing was held on January 19, 1983, to consider the proposed vacation; and WHEREAS, the Board finds that it is in the public interest to vacate the public property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property, described in Exhibit "A", attached hereto and by this reference incorporated herein, is hereby vacated. Section 2. That Donald Pennington is liable for the payment of costs in the amount of $100.00 resulting from this approved vacation. Section 3. That any person liable for payment of costs shall pay the amount of costs established. Section 4. That the Deschutes County Surveyor is directed to mark the plat, if any, as provided in ORS 271.230. Section 5. That this order shall be recorded with the Deschutes County Clerk, and copies shall be filed with the Deschutes County Surveyor and County Assessor. TUTTLE, Commissioner ORDER NO. 83-062 FORM: DPW - VAC 12 45 ,,~,uc753 A portion of Pringle Falls Road, located in Township 22 South, Range 10, East of the Willamette Meridian, Sections 2, 3, 10 and 11, Deschutes County, Oregon, more particularly described as: That portion of Pringle Falls Road, as established on July 13, 1920, from the low water mark on the East bank of the Little Deschutes River, Westerly to the West 1/16 line of said Sections 10 and 13. SUBJECT TO the reservation of a utilities easement in and upon all of the property; for the purposes of continuing, constructing, installing, maintaining, repairing, reconstructing, replacing, enlarging and altering; wires, poles, pipes, lines, structures, casings, supports, equipment, facilities and appurtenances; at the present and in the future; necessary or convenient; to Deschutes County, a political subdivision of the State of Oregon, its agents, licensees and permittees; forever.
