CLERK WHEREAS, a petition requesting a vacation of a portion of Richardson Road, was filed with the Board of County Commissioners of Deschutes County, Oregon, on June 11, 1981; and WHEREAS, the Board of County Commissioners declared its intent to vacate said Road by Resolution No. 82-060, dated November 24, 1982; and and WHEREAS, notice of hearing was given in accordance with law; WHEREAS, a hearing was held on January 19, 1983, to consider the proposed vacation; and WHEREAS, the Board finds that it is in the public interest to vacate the public property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property, described in Exhibit "A", attached hereto and by this reference incorporated herein, is hereby vacated. Section 2. That Leonard N. Fisher is liable for the payment of costs in the amount of $100.00 resulting from this approved vacation. Section 3. That any person liable for payment of costs shall pay the amount of costs established. Section 4. That the Deschutes County Surveyor is directed to mark the plat, if any, as provided in ORS 271.230. Section 5. That this Order shall be recorded with the Deschutes County Clerk, and copies shall be filed with the Deschutes County Surveyor and County Assessor. TUTPLE, Commissioner ORDER NO. 83-064 FORM: DPW - VAC 12 VOL 45 rr~u 759 A portion of Richardson Road lying in the Southeast one-quarter of the Southeast one-quarter of Section 28, Township 17 South, Range 13, East of the Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: Commencing at the Southeast corner of said Section 28, thence South 890 53' 10" West 586.86 feet, more or less, along the South line of said Southeast one-quarter of the Southeast one-quarter of Section 28 to the point of beginning on the Southwesterly right- of-way line of Alfalfa Market Road; thence South 89° 53' 10" West 737.86 feet, more or less-, continuing along said South line of the Southeast one-quarter of the Southeast one-quarter of Section 28 to the Southwest corner of said Southeast one-quarter of the Southeast one-quarter of Section 28; thence North 00 14' 19" 30.00 feet along the West line of said Southeast one-quarter of the Southeast one-quarter of Section 28; thence North 890 53' 10" East 633.70 feet, more or less, along a line 30.00 feet Northerly of and parallel to said South-line-of the-Southeast one-quarter of the Southeast one-quarter of Section 28 to a point on said South- westerly right of way line of Alfalfa Market Road; thence South 74° 03' 22" East 108.46 feet along said Southwesterly right-of-way line of Alfalfa Market Road to the point of beginning.
