CLERK WHEREAS, a petition requesting a vacation of a portion of River Bend Drive, was filed with the Board of County Commissioners of Deschutes County, Oregon, on August 21, 1981; and WHEREAS, the Board of County Commissioners declared its intent to vacate said Road by Resolution No. 82-054, dated November 24, 1982; and and WHEREAS, notice of hearing was given in accordance with law; WHEREAS, a hearing was held on January 19, 1983, to consider the proposed vacation; and WHEREAS, the Board finds that it is in the public interest to vacate the public property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property, described in Exhibit "A", attached hereto and by this reference incorporated herein, is hereby vacated. Section 2. That the payment of costs resulting from this approved vacation have been waived by the Director of Public Works. Section 3. That any person liable for payment of costs shall pay the amount of costs established. Section 4. That the Deschutes County Surveyor is directed to mark the plat, if any, as provided in ORS 271.230. Section 5. That this Order shall be recorded with the Deschutes County Clerk, and copies shall be filed with the Deschutes County Surveyor and County Assessor. YOUNG, .~Cna LOI RTSTOW UANTE, Commissioner CE A.%TUTTL8, Commissioner ORDER NO. 83-065 FORM: DPW - VAC 12 VOL 45 A strip of land, being part of Estates partial resubdivision, more particularly described as River Bend Drive, River Bend Deschutes County, Oregon, and follows: Beginning at the Southerly corner common to Lots 41 and 40; thence South 56° 14' 36" West 232.02 feet along the Northerly right-of- way of River Bend Drive; thence 142.10 feet continuing along said Northerly right-of-way line and along the arc of a 300.00 foot radius curve to the left, the chord of which bears South 42° 40' 26" West 140.78 feet, to the Southerly corner common to Lots 45 and'46; thence 21.03 feet continuing along said Northerly right- of-way line and along the arc of a 25.00 foot radius curve to the right, the chord of which bears South 530 11' 55" West 20.41 feet; thence 16.22 feet along the arc of a 50.00 foot radius curve to the right, the chord of which bears North 86° 35' 14" East 16.15 feet; Thence North 471 48' 48" East 127.10 feet; thence North 510 04' 14" East 250.61 feet; thence North 330 45' 24" West 1.08 feet to the point of beginning.---- SUBJECT TO the reservation of a utilities easement in and upon all of the property; for the purposes of continuing, constructing, installing, maintaining, repairing, reconstructing, replacing, enlarging and altering; wires, poles, pipes, lines, structures, casings, supports, equipment, facilities and appurtenances; at the present and in the future; necessary or convenient; to Deschutes County, a political subdivision of the State of Oregon, its agents, licensees and permittees; forever.
