CLERK ORDINANCE NO. 83-042 WHEREAS, Deschutes County proposed the redesignation of Murphy Road from a local street to a collector street, the redesignation of Woodside Court from a collector street to a local street, and designating a cul-de-sac at the end of Woodside Court; and WHEREAS, The Bend Urban Area Planning Commission recommended the redesignation of Murphy Road from a local street to a collect- or street, the redesignation of Woodside Court from a collector street to a local street, and designating a cul-de-sac at the end of Woodside Courton January 24, 1983; and WHEREAS, notices of hearings were given in accordance with law; and WHEREAS, the Board of County Commissioners held a hearing on the proposed changes in designation on April 20, 1983; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. To amend Ordinance No. PL-10, Bend Urban Area General Plan, to change the designation of Murphy Road from a local street to a collector street, to change the designation of Woodside Court from a collector street to a local street, and designating a cul-de-sac at the end of Woodside Court. Section 2. To adopt as the Board of County Commissioners' findings and conclusion the Deschutes County Planning Division Staff Report marked Exhibit "A", attached hereto and by this reference incorporated herein. 1 - ORDINANCE NO. 83-042 t Vol, 46 mcE 276 Section 3. This Ordinance being necessary for the immediate preservation of public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage. PLACE: Bend City Commission Room REQUEST: The proposal would change the designation of Murphy Road from a local street to a collector street, and Woodside Court from a collector street to a local street on the Bend Area General Plan. It would also designate a cul-de-sac at the end of Woodside Court. FINDINGS: 1. LOCATION: The subject property is located southerly of the Burlington Northern Railroad tracks, and northerly of Knott Road. 2. ZONING: The area surrounding the subject property is currently zoned RL, Urban Low Density Residential. 3. COMPREHENSIVE PLAN DESIGNATION: Murphy Road is currently designated a local street while Woodside Court is designated as a collector on the Bend Area General Plan. The surrounding property is designated as residential. 4. Murphy Road goes through Ambrosia Acres and Brightenwood Estates III. Woodside Court goes through Ambrosia Acres and Brightenwood Estates IV. 5. Condition #13 of the Deschutes°.County Planning Commission's approval of Preliminary Plat #337, Ambrosia Acres on June 8, 1977 states: "A north-south collector road shall be provided. The horizontal and vertical alignment of this road shall meet a proposed railroad underpass on Murphy Road to the north; and Newcastle Road (proposed) to the south. This road shall be constructed to collector suburban standards." 6. The final plat for Ambrosia Acres was signed in December 1977. 7. Condition #12 of the Deschutes County Planning Commission's approval of Preliminary Plat #309, Brightenwood Estates on June 8, 1977 states: J VOL 46 ?ACE 278 "Newcastle Road (now Murphy Road) shall be constructed to suburban collector standards and extended to the E. W. arterial (now Knott Road). 8. The final plat for Brightenwood Estates III was signed in August 1977• CONCLUSION: The approvals of both Ambrosia and Brightenwood subdivisions required that Murphy Road be built to collector standards, therefore, it should be designated as a collector on the Bend Area General Plan. Also since Murphy Road is the collector street and Woodside Court is the local street, a cul-de-sac should be provided on Woodside Court to prevent through traffic. Based upon the above conclusions, the staff would recommend that Murphy Road be designated as a collector street, Woodside Court be designated as a local street, and that a cul-de-sac be designated at the end of Woodside Court.
