CLERK WHEREAS, on September 21, 1982, the Board of County Commissioners abandoned the project to improve the dedicated roads described as that portion of the roads in Klippel Acres, an unrecorded subdivision, as filed in the office of the County Surveyor, Deschutes County, Oregon, consisting of that portion of Buck Drive lying west of the canal easement, the easterly 700 feet of Doe Lane, all of Stag Lane, and all of Fawn Lane; and WHEREAS, property owners abutting the proposed improvement have requested the Board of County Commissioners rescind the order abandoning the project, and proceed with the project; and WHEREAS, the amended Engineer's Report submitted to the Board of County Commissioners has been reaffirmed by the County Engineer; and WHEREAS, the bid for the construction of the improvements has been reaffirmed by the successful low bidder; and WHEREAS, it is necessary that a hearing on the proposed improvement be held for the purpose of hearing remonstrances to said improvement; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That Order No. 82-334, abandoning certain road improvements in Klippel Acres, be hereby rescinded. Section 2. That the amended Engineer's Report relating to the improvement of certain dedicated public roads known as a portion of Buck Drive, a portion of Doe Lane, all of Stag Lane, and all of Fawn Lane in Deschutes County, Oregon, as amended, be hereby accepted and approved. 1 - ORDER NO. 83-159 VOL 46 fAcF 280 Section 3. That a hearing be set on may 4, 1983, at 10:00 a.m. in Deschutes County Courthouse Annex, Bend, Oregon, for the purpose of hearing remonstrances to the improvements originally initiated by Order No. 82-220. Section 4. That the Director of Public Works be authorized to notifiy benefited property owners of said hearing and proposed improvement, in a form substantially as contained in Exhibit "A", attached hereto and by this reference incorporated herein. The County Engineer has made a favorable report to the Board of County Commissioners regarding the proposed improvement. Upon completion of the proposed improvement, the roads will be accepted into the County Road System, and will be maintained by Deschutes County. The total estimated cost of the proposed improvement and the proposed total amount of the assessment against your land is as shown above. If you object to the proposed improvement and assessments shown in the Engineer's Report, you are required to file written objection, if any, with the Board of County Commissioners, c/o Deschutes County Department of Public Works, 61150 S. E. 27th Street, Bend, Oregon 97702, within 10 days of the date of this notice, or at the public hearing on the proposed improvement before the Board of County Commissioners, which will be held on May 4, 1983, at 10:00 a.m. in the Deschutes County Courthouse Annex, Bend, Oregon, in order to stop this improvement. If more than 50% of the owners of land representing more than 50% of the total amount of the assess- ment for the proposed improvement file objections, the proposed improvement will be declared abandoned and no new resolution shall be filed within a period of one year.
