WIN WHEREAS, a petition requesting a vacation of a portion of Cascade Lakes Highway, was filed with the Board of County Commis- sioners of Deschutes County, Oregon, on February 15, 1982; and WHEREAS, the Board of County Commissioners declared its intent to vacate said Road -by-Resolution No. 82-056, dated November 24, 1982; and WHEREAS, notice of hearing was given in accordance with law; and WHEREAS, a hearing was held on January 19, 1983, to consider the proposed vacation; and WHEREAS, the Board finds that it is in the public interest to vacate the public property; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the property, described in Exhibit "A", attached hereto and by this reference incorporated herein, is hereby vacated. Section 2. That Brooks Resources Corporation is liable for the payment of costs in the amount of $100.00 resulting from this approved vacation. Section 3. That any person liable for payment of costs shall pay the amount of costs established. Section 4. That the Deschutes County Surveyor is directed to mark the plat, if any, as provided in ORS 271.230. Section 5. That this order shall be recorded with the Deschutes County Clerk, and copies shall be filed with the Deschutes County Surveyor and County Assessor. Cha TE, Commissioner LE, Commissioner ORDER NO. 83-056 FORM: DPW - VAC 12 VOL 45 !v;_ 77 A tract of land containing 0.28 acres, more or less, located in a portion of the Southwest one-quarter of Section 6, Township 18 South, Range 12, East of the Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: Beginning at a 5/8 inch iron rod on the Northwesterly right-of-way line of Frontage Road as shown on Plat No. 442, West Ridge, Deschutes County, Oregon, from which the North one-quarter of Section 7, Township 18 South, Range 12, East of the Willamette Meridian, bears South 471 16' 39" East a distance of 994.82 feet; thence following said right-of-way line the following three courses and distances and one curve: North 28° 43' 21" East a distance of 42.01 feet; following the arc of a 265.42 foot radius curve right a distance of 70.03 feet (chord bears North 360 16' 53" East 69.83 feet); North 431 50' 25" East a distance of 85.01 feet; South 460 09' 36" East a distance of 104.90 feet to a point on the Northwesterly right-of-way line of Century Drive; thence South 37° 58' 28" West along said Century Drive right-of-way line a distance of 60.32 feet to a point on the Southeasterly right-of-way line of said Frontage Road; thence following said Frontage Road right-of- way line the following two courses and distances and two curves: North 460 09' 36" West a distance of 26.06 feet; following the arc of a 25.01 foot radius curve left a distance of 39.28 feet (chord bears South 880 50' 03" West 35.36 feet); following the arc of a 205.42 foot radius curve left a distance of 54.20 feet (chord bears South 360 16' 53" West 54.04 feet); South 280 43' 21" West a distance of 7.01 feet to a 5/8 inch iron rod; thence leaving said Frontage Road right-of-way line North 460 09' 35" West a distance of 10.95 feet to a 5/8 inch iron rod; thence following the arc of a 39.21 foot radius curve left a distance of 71.93 feet (chord bears South 810 16' 54" West 62.26 feet) to the point of beginning, the terminus of this description. SUBJECT TO the reservation of a utilities easement in and upon all of the property; for the purposes of continuing, constructing, installing, maintaining, repairing, reconstructing, replacing, enlarging and altering; wires, poles, pipes, lines, structures, casings, supports, equipment, facilities and appurtenances; at the present and in the future; necessary or convenient; to Deschutes County, a political subdivision of the State of Oregon, its agents, licensees and permittees; forever.
