45-441-Ordinance No. 82-047 Recorded 12/29/1982w ~ 3 I vo L 45 ?Ac-,. 44]1- BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Ordinance Renaming a Cer- tain Road in Woodriver * L' E Village From Pinewood Road to Pineriver Road; Declaring DE an Emergency, and Providing 2 1982 an Effective Date. * ROSE DESCH T MARY FATTERSOW COU1'Ty CLERK ORDINANCE NO. $2-047 WHEREAS, the Bend Urban Area Planning Commission has held a hearing on the issue of renaming a certain road in Woodriver Village; and WHEREAS, ORS 215.110 requires that the renaming of roads be by Ordinance; and WHEREAS, the renaming of Pinewood Road was coordinated through the Bend Urban Area Planning Commission and by the Deschutes County Planning Department; and WHEREAS, the renaming of the road will eliminate confusion between similarly named roads within the urban area; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. That Pinewood Road in Woodriver Village be renamed Pineriver Road. Section 2. That the Board of County Commissioners adopt as its findings and conclusions the Deschutes County Planning Department Staff Report, marked Exhibit "A", attached hereto and by this reference incorporated herein. Section 3. City Council Chambers 2-Bend Urban Area Planning Commission SUBJECT: Proposal for a road renaming in Woodriver Village which would change Pinewood Road to Pineriver Road. PROPONENT: Deschutes County Board of Commissioners Courthouse Annex Bend, Oregon 97701 LOCATION: The subject road is located in the Woodriver Village subdivision between the north and east segments of Alderwood Circle. - STAFF FINDINGS I. Legal Findings A. ORS 215.110 authorizes planning commissions to recommend to the governing body ordinances to provide for the-renaming of public thoroughfares. II. Basic Findings A. The subject road is a paved local street in the Woodriver Village subdivision. The name Pinewood Road was established in 1972. B. In the spring of 1981, based upon a recommendation by the Bend Fire Department and U.S. Postal Service, a list of duplicate street names within the Bend Urban Area was compiled by the City of Bend and Deschutes County. The list included Pinewood Road located in Woodriver Village subdivision, and Pinewood Drive within the City. On June 1, 1981, the duplicate names were presented to the tend Urban Area Planning Commission for a recommendation of appropriate action to be taken by the Bend City Commission and the Board of County Commissioners, At that time, the Planning Commission post- poned a decision on renaming Pinewood Road or Pinewood Drive until the June 22, 1981 meeting. Based upon public testimony received during the June 22 hearing, the Planning Commission unanimously recommended the Board of Commissioners change the identification of Pinewood Road to another suitable name. Following the June 22 hearing, residents of Pinewood Road protested a lack of notification on the proposed renaming. City Planning Staff subsequently recommended an additional hearing on the road name change by the Planning Commission during the July 27, 1981 meeting. Public testimony against the proposed renaming was provided by Pinewood Road residents at the July 27 hearing, and the Planning Commission voted to uphold the.decision of June 22. 't PAGE a is- 'aff° Report Road" Renaming Notification of a September 2, 1981 public hearing to allow con- sideration of the road renaming by the Board of County Commissioners, was mailed to Pinewood Road residents on August 20, 1981. The Commissioners received testimony in opposition to redesignate Pinewood Road at the September 2 hearing. The Board subsequently voted against renaming Pinewood Road and recommended the City of Bend redesignate Pinewood Drive. Following a public hearing on November 4, 1981, the Bend City Commission took no action toward renaming Pinewood Drive in the City. Instead, the Mayor was directed to consult with the Board of County Commissioners in order to reach a solution in the Pinewood - Road renaming. On December 10, 1981, the Board of County Commissioners voted to rename Pinewood Road in the Woodriver.Village subdivision. The decision was based upon testimony by Bend Mayor Ruth Burleigh and a previous recommendation by the Bend Urban Area Planning Commission. A form letter mailed to Pinewood Road residents on December 29, 1981 outlined the Board of Commissioners decision and requested an indication of preference among five alternative road names. Of the nine letters delivered by the postal service, six were answered and returned to the planning department. Four of the six respondents indicated a preference for Pineriver as the alternative road name, one preferred Cottonwood, with Pineriver as a second choice, and one selected Pinecreek. C. There are 12 residences in Woodriver Village with driveway access to Pinewood Road. D. The U.S. Postal Service will deliver mail addressed to either the old or new address of a residence affected by a street name change for up to one year after the effective date. III. Conclusion and Recommendation Based upon the above findings, the staff would recommend the renaming of Pinewood Road to Pineriver Road. JBM/ns 1-27-82
