Hearing no ob- Jections, the Chairman so amended the agenda. Paperwork for Craig Smith, Planning Department, brought this before Planning: FP the Board for signature and approval. .#509, Star- MOTION: YOUNG moved to approve Final Plat 4509 of wood Starwood. SHEPARD: Second. VOTE: SHEPARD: AYE. PAULSON: ABSTAIN. YOUNG: AYE. Final Plat Mr. Smith explained that this was a Type II subdivision #632, Turner located off of Larson Road and zoned EFU-20 creating Tracts four 20-acre parcels. YOUNG: AYE. Discussion Lin Bernhardt, Planning Department, explained that regarding Fee Angel Wing Ranch is a home for wayward girls owned Waiver for by Mrs. Abbot. Mrs. Abbot would like to place an Mrs. Abbot 8' x 33' trailer on the property to house ranch help, of Angel Wing because she cannot take care of the property herself. Ranch Because this mobile home does not meet the 500 square foot minimum she did need a variance to place this trailer as a conditional use. She would also like to get a temporary placement permit so that the home can be installed right away. The fees for this total $410-- $110 for the conditional use, $260 for the var- iance and $40 for the temporary use permit. This will require two different staff reports that will be very similar. Mrs. Abbot briefly explained her situation, saying that her only income is $300 per month social security and donations to the ranch from people. She is getting the small trailer because she can trade for it, instead of having to use cash. Commissioner Paulson suggested that she contact the Juvenile Services Department to see if they have any funds. She stated that they cannot help her with funding but they do refer cases that they cannot help to her and she takes them in. MOTION : PAULSON moved that the Board waive the $110 conditional use fee and require the payment in advance of the variance and the temporary use permit. YOUNG: Second. VOTE: SHEPARD AYE. Discuss;ionir,e-Before the Board was a memo from Rick Isham dated November garding.C.olum-10, 1982 in regard to the detention of juveniles in bia County Columbia County and the lawsuit pending as a result Juvenile Jail of Judge Fry's decision. The Board briefly discussed Lawsuit this, noting that assistance from other counties in the state has been requested by Columbia County-- assist- ance in the form of money or counsel. This had been discussed at the County Counsel meeting at AOC. Since Mr. Isham was not present at this time, it was agreed to postpone further discussion of this item until he could be present. Other Staff/ Mike Maier, Administrative Services, stated that at Public Con the'next week's meeting they will be discussing the cerns reorganization of the Clerk's office as it relates to the State taking over Court functions. OLCC License Before the Board was an OLCC application for greater for Greater priveledge to Sundown South Saloon. Page 2of 4 Deschutes County Board of Commissioners ,f November 23, 1982 - Regular Meeting VLt 44 FA.€~ 705D Discussion Mr. Isham explained that this is similar to the Denake regarding case in which a group of attorneys from various counties Columbia Co. get together for the purpose of providing counsel with Juvenile Jail respect to a particular litigation. Columbia County Lawsuit has requested help of this nature or financial assistance to assist in the cost of the lawsuit. The team of lawyers would work to persuade the court to modify its decision. This is a Federal court case and would go to the Federal Court of Appeals. There was some further discussion of the decision and of the Columbia County facility.. It would be intended that they.would file an amicus appearance. Because this could potentially affect Deschutes County, Chairman Shepard felt that we should render any assistance necessary. MOTION: YOUNG moved that the Board approve the part- icipation of Deschutes County Counsel to what- ever extent counsel considers prudent. PAULSON• S and ec - Mr. Isham stated that he would not take any action without first getting board approval. VOTE: SHEPARD: AYE. PAULSON: AYE. YOUNG: AYE. Requests for Before the Board were two requests for refund. The Refund first was from the Environmental Health Department in the amount of $135. The second was from the Planning department in the amount of $180. The Board approved the requests. Final Hearing This was a public hearing on the supplemental budget on Supplement-and appropriation of funds. Chairman Shepard opened al Budget the hearing. Mike Maier, Administrative Services, stated that there were some.adjustments since the first meeting with the Budget Committee, which he outlined. It had been assumed that the unappropriated balance could be appropriated, but it has since been determined that they cannot. This money will be guaranteed cash carry- over for the next year. Because this money cannot be appropriated, this will reduce the budget figure by $120,074 in the General Fund and $100,000 in the Road fund. The Road fund money had been intended to be put in the Road Contingency fund. The $120,074 in the General Fund had been intended to go toward the post office building purchase. Instead, this money will have to ben taken from the Contingency fund. Mr. Isham noted that the Road fund contingency will be made up when the liens for LID's start coming in. Hearing no further comments, Chairman Shepard closed the hearing.
