Gordon Smith then came forward to testify. He read aloud a letter he had written, in which he quoted ORS 198.815. He did not feel that the Board should accept the petition at this final hearing. He felt that be- cause the petition was not yet filed it was not legal to accept the petition which prevented the hearing. Rick,Isham, County Counsel, stated that he is not aware of any requirement in the formation statute which states that signatures must be verified prior to the hearing. Under most statutory requirements the Clerk has ten days to determine the validation of signatures. MOTION: YOUNG moved to continue the hearing for two weeks until signatures could be validated. He stated that Carol Freed cerns would be filling this position. Commissioner Young noted that she is already on the payroll because of her other part-time work.
