ORDER NO. 82-334 CLERK
WHEREAS, on April 28, 1982, the Board of County Commissioners
initiated by Resolution the improvement of dedicated public roads
known as a portion of Buck Drive, a portion of Doe Lane, all of
Stag Lane, and all of Fawn Lane; and
WHEREAS, the Resolution was referred to the County Engineer,
who investigated the improvement and estimated the cost of the
improvement, and a cost estimate of the improvement has been
prepared in accordance with ORS 371.625; and
WHEREAS, the project was put out for bid based on the
Engineer's estimate; and
WHEREAS, the bid prices exceeded the Engineer's estimate by
approximately $24,000.00; and
WHEREAS, an amended Engineer's Report was prepared; and
WHEREAS, notice pursuant to ORS 371.630, based on the amended
Engineer's Report, was mailed to each benefited property owner;
and
WHEREAS, a hearing on the proposed improvement was held on
September 1, 1982; and
WHEREAS, a number of objections have been filed with the
Board of County Commissioners regarding said improvements; and
WHEREAS, the Board of County Commissioners taking into con-
sideration the testimony of the persons who appeared at the hear-
ing against the proposed improvement, the uncertainty of the
County's ability to finance the improvements, and the increased
cost of the improvement over the original Engineer's estimate;
now, therefore,

OREGON, ORDERS as follows:
Section 1. That the improvement to improve the dedicated
roads described as follows:
That portion of the roads in Klippel Acres, an unre-
corded subdivision, as filed in the office of the
County Surveyor, Deschutes County, Oregon, consisting
of: that portion of Buck Drive lying West of the
canal easement, the easterly 700 feet of Doe Lane, all
of Stag Drive, and all of Fawn Lane.
be abandoned, and all bids for the construction of said project be
rejected. /
