Commission- er Paulson and Commissioner Young were also in attendance. Amendments to The Chairman amended the agenda to include a discussion the Agenda regarding Employment Relations Board election. It was noted that the representatives of the local news media had been previously notified by telephone of this amend- ment. Discussion re- Chairman Shepard stated that the Board had reviewed a garding ERB a letter from the Employment Relations Board (ERB) which Election ordered the Board to conduct a new election. Bruce Bischof, Labor Counsel for Deschutes County, stated that the Board has three options in response to the order which were: (1) go ahead with the election; (2) not participate but remain silent and let them conduct the election and not comply with the results of the elect- ion; or (3) seek legal action to injuct the election from occurring. Commissioner Young stated that the first election should be investigated first, and until such time as an invest- igation had been conducted, he would have no confidence ifs the competence of'ERB to conduct an election. At this time there was an urgent telephone call for Chair- man Shepard in regard to this matter and the meeting was recessed. At 10:10 A.M., Chairman Shepard recessed the open meeting to conduct an executive session for the purpose of discussing litigation. The open meeting was reconvened at 10:34 A.M. MOTION: YOUNG moved to instruct County Counsel and the official labor counsel to take whatever legal action necessary to forestall another union election until such time as an investigation has been done to the Board's satisfaction. Discussion re- Neil Hudson, Director of Public Works, explained to the garding Knott Board the results of a traffic study the Public Works Road Traffic Department had recently completed on portions of Knott Study Road. These results were diagramed on a map. It indicated the average number of vehicles per day over certain sections of the road, as well as the average speed of traffic over certain sections of the road. They figured the average speed by taking the lower 85% of all traffic and averaging that speed. He explained that the rationale for this is that approximately 85% of OCTOBER 19, 1982 MINUTES: PAGE 1 ~r VOL 44 PAGE 350 the population drives in a safe manner and the other 15% do not. Based on this study, they are recommending to the State Speed Control Board that the speed limit for that portion of Knott Road be established at 45 miles per hour. He said that one other question in regard to this road's use is whether or not trucks will be permitted to use the road. In his opinion the road is not structurally strong enough to handle truck traffic but by limiting the speed to 45 miles per hour, it should deter truck travel. He also suggested that they could consider making a weight limit that would restrict 18-wheel trucks from using the road. He also noted that there had been some concern about this route being used as a truck by-pass, but he did not feel that this was likely as it has been determined that Bend is a destin- ation for most travellers, for gas and food, etc. MOTION: PAULSON moved that they recommend to the State Speed Control Board a 45 mile per hour speed limit from 15th Street to China Hat Road. Appointment to The Board had received a letter from Rex Garrett of the Lazy River Lazy River Vector Control District requesting that they Vector Con- appoint Mrs. Emily Boyd to their B oard of Directors to trol District replace John Macy who has left the area. Board of Dir- MOTION: PAULSON moved to appoint Mrs. Emily Boyd, ectors 53130 Bridges Dr., to the Lazy River Vector Control District Board of Directors. YOUNG: Second. VOTE: SHEPARD: AYE. YOUNG: AYE. .Contracts for Mr. Hudson explained that the Board has already awarded Paving of the bids which contained the contracts, and now the con- American Ave. tracts are ready for Board signatures. The Board signed and Simpson the contracts, which were with R.L. Coats. Road MP-82-18, Lin Bernhardt, Planning Department, brought this before Mike Gibney the Board for approval and signature. She explained that this created one 243-acre parcel and one 82-acre parcel. MOTION: YOUNG moved to approve MP-82-18. PAULSON: Second. VOTE: SHEPARD: AYE. PAULSON: AYE. YOUNG: AYE. PP# 634, Pete Lin Bernhardt brought this before the Board for signat- Hester ure and approval. Wednesday, so they would have to approve this subject to there being an appeal filed, and they would have to sign it Thursday. MOTION: PAULSON moved that Preliminary Plat #634, for Hester be approved subject to there being no appeal filed before the appeal deadline and signed Thursday after the expiration of the appeal period. YOUNG: Second. VOTE: SHEPARD: AYE. PAULSON: AYE. YOUNG: AYE. Order #82-348 Chairman Shepard read the order aloud for the record. Providing for MOTION: YOUNG moved to approve order #82-348. The Refund first was to Trout Realty in the amount of $45 from the Environmental Health Department. The second was for Village Steelworks in the amount of $18.20 from the Building Department and the third was for Albert Santiago in the amount of $40 from the Planning Department. There being no further business at this time, the Board recessed the meeting until 10:00 A.M.
