BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Authorizing the Board Chair to Sign
Appointment of Successor Trustee
ORDER NO. 2004-038
WHEREAS, in the past the County appointed or authorized the County Legal Counsel,
Richard Isham, to serve as Trustee in real property transactions where the County, as Beneficiary,
received from the purchaser a Trust Deed to secure the purchaser's promissory note; and
WHEREAS, upon satisfaction of a promissory note secured by trust deed it is the trustee's
responsibility to issue a deed of reconveyance, which acts to release the real property from the
security interest encompassed by a trust deed; and
WHEREAS, inasmuch as Richard Isham is no longer county legal counsel and no longer
serves as trustee, it is necessary for the Board, acting through the Board Chair to execute a document
indicating that the county's current legal counsel is or has been appointed as successor trustee to act
in place of Richard Isham; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDERS as follows:
Section 1. The Board Chair is authorized on behalf of the County to execute one or more
documents appointing the current county legal counsel to act as successor trustee in all real property
transactions in which Richard [sham had been appointed or served as Trustee on a Trust Deed, and
in which Deschutes County was the Beneficiary.
