39-338-Resolution No. 81-061 Recorded 8/12/1981VOL 39 PAGE 338 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Declaring the Necessity to Acquire and the Purpose of Acquiring Fee Simple Title to Certain Real Property for a Road Right of Way, and Directing the Director of Public Works and County Legal Counsel to Proceed with the Acquisition of the Property. ) ) ) ) ) ) ) ) 1' e I �� 1 1981 ROSEM.4Ry PATTERS DESCHUTES COUNTY ON CLERK RESOLUTION NO. 81-061 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon, has determined that it is necessary to obtain certain property located in Deschutes County, Oregon, for the purpose of constructing and maintaining a road; and WHEREAS, under the provisions of Chapter 35, it is necessary for the Board of County Commissioners to declare the necessity of acquiring said real property when the necessity exists to carry out the purposes of said public improvement; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That the Board of County Commissioners of Deschutes County, Oregon, deems it necessary and expedient, and in the public interest, that for the purposes of constructing and maintaining a roadway, that Deschutes County, a political subdivision of the State of Oregon, acquire fee simple title to the real property described as follows: A parcel of real property located in Section 5, Township 18 South, Range 12 East of the Willamette Meridian, Deschutes County, Oregon, more particularly described as follows: Beginning at the Northwest corner of Lot 11, Virginia Park, and run thence East 53.01 feet; thence South 4° 02' 15" East 16.75 feet; thence on a 370.00 feet radius curve left (the chord of which curve bears South 10° 36' 48" East 84.75 feet) a distance of 84.93 feet to a point on the South line of said Lot 11; thence along the South line of said Lot 11 West 69.80 feet to the Southwest corner of said Lot 11; thence along the West line of said Lot 11 North 100.00 feet to the place of beginning, contain- ing 5921.81 square feet, more or less. That Deschutes County, Oregon, has not been able to agree witF-the owners of said real Droperty as to the compensation to be paid therefor, and the Director of Public Works is authorized to further negotiate in an attempt to agree with the owners as to the compensation to be paid for the real property sought to be acquired. Section 3. That in the event no satisfactory agreement can be reached, t e Deschutes County Legal Counsel is hereby authorized to institute a proceeding in eminent domain for the acquisition of the land hereinabove described, and to seek immediate possession of said land.
