WHEREAS, barriers and gates are used to restrict traffic on
certain roads under the jurisdiction of Deschutes County; and
WHEREAS, these gates and barriers are placed as to prohibit
motor vehicle traffic beyond the point where the barrier or gate is
placed; and
WHEREAS, the intent of the Board of County Commissioners by
the erection of such barriers and gates is to provide official
traffic control devices to prohibit motor vehicle traffic beyond the
point of the barrier or gate; and
WHEREAS, ORS 487.120 requires obedience to traffic control
devices, and makes it a Class B Traffic Infraction for the failure to
obey such a device; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. That barriers and gates on and across roads and
highways under the jurisdiction of Deschutes County shall constitute
official traffic control devices within the meaning of ORS 487.005.
Section 2. That official traffic control devices consist-
ing of barriers and gates on and across roads and highways may be
established by Resolution of the Board of County Commissioners upon
and across any road or highway under the jurisdiction of the County
for the purpose of prohibiting motor vehicle traffic on the road or
highway beyond the barrier or gate so established.
Section 3. This Ordinance being necessary for the
immediate preservation of public peace, health and safety, an
emergency is declared to exist, and this Ordinance takes effect on
its passage.
