That Section 5.000, Notice of Hearing, of Ordinance No. PL-9, Deschutes County Uniform Hearings Procedure Ordinance, as amended, is amended to read as follows: Section 5.000. Notice of Hearing. (1) Notice for applications for a land use permit, other than transmission or other major utility lines, shall be given at least ten (10) days prior to said hearing. Written notice shall be sent by mail to the following persons: (a) The applicant; (b) All property owners of record, as shown on the official maps of the Deschutes County Tax Assessor, within 250 feet of the property which is the subject of the application. ORDINANCE NO. 81-051, PAGE 1 y d VOL 41 PALE 56 (c) The failure of a property owner to re- ceive mailed notice shall not invalidate any land use action if a good faith effort was made to give notice required by this section. The date of mailing shall be considered the date of notice. (2) Notice for transmission or other major utility lines, shall be by posting the proposed route of the transmission or other ri,ajor utility line at intervals of not less than half mile. The notice shall be posted as close as prac- ticable and be visible from any public way in the vicinity of the proposed route. Notice under this section shall be not less than 18 x 32 inches in size, and shall contain the word "NOTICE" in letters not less than two inches in height. Section 2. This Ordinance being necessary for the immediate preservation of public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
