ORDINANCE NO. 81-057
WHEREAS, the Board of County Commissioners held a hearing
relating to a zone change for Vandevert Acres South on September 9,
1981; and
WHEREAS, notice of hearing was given in accordance with
law; and
WHEREAS, the Board of County Commissioners decided to
change the zoning of the property from forest use (F-2) Zone to Rural
Residential (RR-10) Zone by decision dated September, 1981; and
WHEREAS, the decision of the board of County Commissioners
has not been appealed to the Land Use Board of Appeals; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDAINS as follows:
Section 1. To amend Ordinance No. PL-15, Deschutes County
Zoning Ordinance of 1979, to change the zoning from forest use (F-2)
Zone to Rural Residential (RR-10) Zone for that real property
described as Vandevert Acres South located in Section 20, Township 20
South, Range 11 East, Willamette Meridian, Deschutes County, Oregon,
containing 56 acres, more or less, and depicted on the map marked
Exhibit "A", attached hereto and by this reference incorporated
herein.
Section 2. To adopt as the Board of County Commissioners'
findings and conclusions, the finding as contained in the Deschutes
County Planning Department Staff Report relating to Zone Change No.
Z-81-20, marked Exhibit "B", attached hereto and by this reference
incorporated herein.

Section 3. This ordinance being necessary for the
immediate preservation of public peace, health and safety, an
emergency is declared to exist, and this Ordinance takes effect on
its passage.

1. The subject property is 56 acres in size.
2. Surrounding land ownership is: National Forest Service property
to the east and south; large lot private ownership to the west;
and Vandevert Acres (subdivision) to the north.
3. Surrounding land uses include: open space and forest related
uses to the east, south and west; and subdivided lots to the
north.
4. Plat 308, Vandevert Acres South, was given final approval in
September of 1978. The plat was given preliminary approval
in 1977, although no record of..this action has been found.
5. The subdivision contains eighteen two-acre lots with remainder
of the land being held as common area.
6. Power and telephone service are provided by an underground system.
All roads have been created and are surfaced (cinders).
7. Four single-family dwellings exist within the subdivision. Two
of those permits were issued after November 1, 1979 without
meeting the proper conditions and-thus have not been legally
issued.
8. The existing vegetation includes: a moderate to heavy stand of
lodgepole and an undercover of bitterbrush and natural grasses.
The National Forest Service classifies this property as site
class V or moderately high. This is a commercially productive
site class.
9. Surrounding properties are zoned: F-2 to the east, south, and
west; and RR-10 to the north.
