This matter came before the regular term of the Board of County
Commissioners acting as the governing body of the Seventh Mountain County
Service District on December 22, 1981, at the request of Louis B. Dvorak,
counsel for the District.
WHEREAS:
1. The District's Ordinance Spreading Assessment dated August
12, 1981, levies an assessment optionally payable in installments pursuant
to the Bancroft Bonding Act, ORS 223.205 and 223.210 to 223.295, made
applicable to the District by ORS 451.530(1)(a);
2. ORS 223.230 requires that after expiration of the time for
filing applications to pay the assessment in installments an officer
appointed by the governing body "shall enter in a docket kept for that
purpose under separate heads" for each improvement project, "by name
or number, a description of each lot...or other property against which
the assessment is made, or which bears or is chargeable with the cost
of the improvement with the name of the owner and the amount of the unpaid
assessment."
3. Applications to pay $779,246.25 of the assessment in installments
have been received, Deschutes County is responsible for collecting these
installments and accounting for them, and the District will propose a Bancroft
Bond issue which will include an adequate administrative fee to pay for these
services; and
4. The County Treasurer is able to set up and maintain the docket
required by ORS 223.230 and do the collection and accounting necessary to
administer the District's Bancroft Bonding program;
Now, therefore, it is ORDERED that:
1. The County Treasurer shall set up and maintain the docket
required by ORS 223.230 and all other records required properly to administer
the District's Bancroft Bonding Program, collect and account for the
installment payments on the assessment and disburse it as required by
District ordinances and orders of this Board.
2. The County Treasurer shall include in the next proposed budget
for that department an allowance for the cost of doing the foregoing
work„ not exceeding the amount allowed for administrative fees to the County
