THOMPSON, have petitioned the Board of County Commissioners for a way of necessity over and across land abutting their property; and WHEREAS, ORS 376.160 provides that the County Engineer investigate the proposed way of necessity; and WHEREAS, said statute requires the service of the petition on the owners of property over which the way could be located; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the petition on file herein be referred to the County Engineer for investigation in accordance with ORS 376.160(2), and the Engineer's report be filed with the Board of County Commissioners on or before February 1, 1982. Section 2. That the petition to establish the way of necessity on file with the Board of County Commissioners be served on the owners of land across which the way of necessity could be located. That this order be served on the Petitioner and all persons entitled to service in accordance with Section 2 of this order. Section 4. That the Petitioners herein shall deposit with the County the amount of $250.00 for County expenses relating to the proceeding for the establishment of the way of necessity.
