WHEREAS, the Board of County Commissioners of Deschutes
County, Oregon, views with concern the potential long term and
irreparable damage that would occur to important Deschutes County
resources; such as recreation, tourism, scenic qualities, water-
shed, soils, and wildlife; should conflicting uses and activities,
such as gold mining, be permitted in sensitive alpine or riparian
areas; and
WHEREAS, the Deschutes County Year 2000 Comprehensive Plan
calls for the protection of important natural resources, such as
watersheds and wilderness areas; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That the United States Forest Service not permit
gold mining in those areas of Deschutes County contained within
congressionally designated Wilderness Areas, RARE II Roadless
areas, domestic watersheds, or other fragile riparian or alpine
areas.
Section 2. That where the United States Forest Service is
unwilling or unable to withdraw lands from gold mining in sensi-
tive areas, the greatest possible degree of restraint in allowing
claims, and particularly in approving operating plans for mining
in Deschutes County, should be exercised to minimize damage to the
environment.
Section 3. That the strictest possible interpretation be
applied to the "Prudent Man" and "Marketability" tests in order to
place the full burden of proof of profitability on the prospective
gold mine claimant.
