41-691-Resolution No. 82-008 Recorded 3/11/1982r Aj BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Exempting The * F r L E Contract For The Purchase of * D a New Caterpillar 140G Motor * MAR Grader From Competitive 111982 Bidding * ROS RESOLUTION NO. 82-008 �E•SCy TSRCOU ry CL N NTY CL,gQK WHEREAS, the Public Works Department has surveyed the availability of new motor graders within the State of Oregon and Deschutes County; and WHEREAS, the purchase of a new motor grader for the Department of Public Works would normally be bid under a total cost bid for a ten (10) year or ten thousand (10,000) hour period of operation; and WHEREAS, current economic conditions, high interest rates, and the unavailability of sufficiently appropriate security for the total cost bid make such a bidding procedure inappropriate; and WHEREAS, two (2) used Caterpillar graders described as a 1964 Model 12E 99E 9562 and a 1969 Model 12F 13K 2486 are to be used as trade-in on any new motor grader; and WHEREAS, such used equipment is, to a certain extent, unique by the nature of being in as is condition; and WHEREAS, Deschutes County currently owns three (3) Cater- pillar graders, two of which are essentially identical to a proposal submitted by Pape' Bros., Inc.; and WHEREAS, the County currently stocks spare parts for Cater- pillar graders, making the estimated cost savings to the County in excess of any perceived cost savings by any proposal other than for a Caterpillar motor grader; and WHEREAS, proposals were requested from any and all persons who would be interested in supplying the County's .requirement in a motor grader; and WHEREAS, two (2) proposals were received, one from Pape' Bros., Inc., in a net purchase price of SIXTY FOUR THOUSAND TWO HUNDRED FIFTY FIVE DOLLARS and No/100 ($64,255.00) for Caterpillar equipment, and another proposal from Hessel Tractor & Equipment Company in the amount of SIXTY TWO THOUSAND ONE HUNDRED FORTY TWO DOLLARS and No/100 ($62,142.00) for John Deere equipment; and 1 - RESOLUTION NO. 82-008 4 WHEREAS, John Deere equipment operates in a substantially dissimilar manner from Caterpillar equipment, which would result in increased safety hazards in the operation of the equipment; and WHEREAS, utilizing the concept of total cost bid, with respect to the proposals received, Caterpillar graders will have a significantly higher residual value based on information available to the Public Works Department; and WHEREAS, the exemption from competitive bidding will result in a substantial cost savings over the life of the equipment, a limited number of persons are available to make proposals or bids on such equipment, and considering the other factors as are set out above, the Board of County Commissioners has determined that the lack of bids will not result in favoritism or substantially diminish competition in awarding the contract; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That exemption from the requirements of County Ordinance 203-8 be granted for the purpose of purchasing one (1) new Caterpillar 140G Motor Grader as proposed by Pape' Bros., Inc., in the total cost of SIXTY FOUR THOUSAND TWO HUNDRED FIFTY DOLLARS and No/100 ($64,255.00) F.O.B. Deschutes County Shops, Bend, Oregon. Section 2. That the Director of Public Works is authorized to enter into an acceptable purchase agreement for the purchase of said equipment.
