WHEREAS: 1. This Board finds that the wastewater treatment facility and collection system of the District has been completed and the total cost thereof has been determined, as set forth in Exhibit A, attached hereto and incorporated here by this reference; 2. The nature of the facility and system is that it benefits all and only the condominium units connected to it, and therefore all and only these units should be assessed for the cost thereof; 3. Prior to the commencement of construction of the facility and system, all the property owners in the District were duly given notice of the proposed improvements, and a duly noticed hearing was held at which remonstrances could be made to the proposed improvements, and there were none; and 4. Howard Kraus, District Engineer, as authorized by this Board has prepared a proposed assessment to the respective lots within the District, which is attached hereto as Exhibit B, incorporated here by this reference, and this proposed assessment will be on file at the offices of this Board from the date of this order and resolution; NOW, THEREFORE IT IS RESOLVED that: 1. Pursuant to Section 9 of the District's General Assessment Ordinance dated September 5, 1979, and ORS 223.389, the lots and units within the Seventh Mountain County Service District are proposed to be assessed $825,000 for the cost of construction of the District's wastewater treatment facility and collection system; 2. The allocation of this assessment among the lots and units benefited by the said facility and system is proposed as set forth in Exhibit B, incorporated here by this reference; 3. On August 12, 1981, or ten days from the mailing of notice thereof, whichever is later, this Board will hold a hearing at 11:00 a.m, at the Board of Commissioners' Conference Room, Deschutes County Courthouse Annex, Bend, Oregon to consider any objections to the assessments proposed herein. Owners of real property within the district may appear at this hearing and be heard, and may file written objections to the assessment proposed herein on or before that date and time. Written objections may be filed with the secretary of the Board VOL 38PAGE 66 Resolution Proposing Assessment Page 2 of Commissioners. 4. At the time of the hearing the Board will consider adoption of an ordinance spreading the assessment as adopted, pursuant to Section 8 of the District's General Assessment Ordinance and ORS 223.389, according to the special and peculiar benefits accruing to each lot and unit in the District. 5. The District Engineer shall forthwith mail notice by ordinary mail of the hearing, in the form set forth in attached Exhibit C, incorporated here by this reference, to each owner assessed. 6. The District Engineer shall publish notice of the proposed assessment in the Bulletin, a newspaper of general circulation in the District, once at least ten (1,0,)) days before the hearing set in paragraph 3. Any written objection to the assessment roll must be received in the office of the Board of County Commissioners, Deschutes County Courthouse Annex, Bend, OR 97701, by August 11, 1981, and state the ground of objection. The total amount of the assessment is $825,000 to pay for construction of the District's wastewater treatment facility and collection system, which is now completed. Your share of the assessment is shown opposite your name on the partial copy of the assessment roll on the reverse of this notice, or attached. The basis of allocation of the assessment is your percentage ownership of the common element of the Inn of the Seventh Mountain condominium. After the assessment is finalized, owners of the assessed properties have the right, under ORS 223.205-223.295 (the Bancroft Bonding Act), to pay assessments exceeding $25 in installments. It is anticipated that the installments will be payable over a period of 10 years. If the owner fails to apply to pay the assessment in installments within 10 days after the first publication of the notice of assessment after the hearing, the full amount of the assessment must be paid within 30 days of the date of entry of the assessment in the unbonded lien docket by the County Clerk. If the assessment is not so paid, interest at the rate of 12% per annum will run from the 30th day after such entry, and the property assessed will be subject to foreclosure. A form required to apply to pay the assessment in installments accompanies this notice.
