That Section 1 of Order No. 81-208 is amended to read as follows: "Section 1. That the territory described in Exhibit 'A, attached hereto and by this reference incorporated herein, is formed into the special road district known as River Bend Estates Special Road District." EXCEPTING that portion of Section 24, Township 18 South, Range 11 E.W.M. lying West of Lot 81 (Tax Code 0104- 181124-00-00400), Lot 132 (Tax Code 0104-181124-00-01600), Lot 133 (Taff Code 0104-181124-00-01700), Lot 124 (Tax Code 0104-181124-00-02400) as platted November 9, 1961, River Bend Estates, Subdivision 1, Deschutes County, Oregon. vo►PACE,®~ / 4~ AGREEMENT 00 THIS AGREEMENT, made and entered into this day of VIES Y p 1981, by and between DESCHUTES COUNTY, OREGON, a COUP INO political ubdivision of the State-of Oregon, hereinafter referred IY N to as "County", and THE CITY OF BEND, OREGON, a municipal corporation ok hereinafter referred to as "City", witnesseth: WHEREAS, County and City established, effective January 1, 1981 a Joint City-County Urban Area Planning Commission for the Bend Urban Area; and k[HEREAS, City desires to employ the services of the Deschutes County Hearings Officer for City hearings within the Bend Urban Growth Boundary; and WHEREAS, Deschutes County employs a Hearings Officer who is licensed to practice law in the State of Oregon and is qualified to hold hearings on land use applications within the Bend Urban Growth Boundary; now, therefore, IT IS HEREBY AGREED by and between the parties above mentioned, for and in consideration of the mutual promises hereinafter stated, as follows: 1. Period of Agreement. This Agreement is effective July 1, 1981, and shall terminate at 12:01 a.m. on July 1, 1982. 2. Hearings Officer. County shall make available its Hearings Officer for hearings on land use applications within the Bend Urban Growth Boundary and under the jurisdiction of the City. 3. Charges for Service. City shall pay County $350 per month for the services of the Hearings Officer and his staff. This amount is an estimate of the amount of salaries and overhead for the Hearings Officer, staff and office expenses based on an average of 20 hours per month. 4. Office Supplies. City shall supply Hearings Officer with necessary office supplies, stationery, and postage for work performed under this Agreement. 5. Accounting. County's Hearings Officer shall maintain time records relative to work performed under this Agreement, and report upon the termination of this Agreement the number of hours expended with respect to this Agreement. 6. Scheduling. County's Hearings Officer shall schedule hearings at convenient times and coordinate said times with City staff. It is anti- cipated that the Hearings Officer's current schedule will be used for all or the majority of hearings scheduled. 6 AGREEMENT, PAGE 1 \),Ot 38 95 a©~ r' 7. City Designation. County's Hearings Officer shall be designated, for the purpose of this Agreement, the City of Bend Hearings Officer. 8. Records. Records of hearings, agendas, minutes, exhibits and the decisions of the Hearings Officer resulting from this Agreement shall be the property of City. County's Hearings Officer shall main- tain duplicates of agendas, minutes, decisions and notes and memoranda in County files.
