WHEREAS, a petition requesting the annexation of territory
to Deschutes County Rural Fire Protection District No. l was duly
filed with the Board of County Commissioners of Deschutes County,
Oregon, on October 30, 1980; and
WHEREAS, a public hearing was held on the petition on
January 21, 1981, to hear the petition and any objections thereto,
and to determine whether, in accordance with the Comprehensive Plan,
applicable Land Conservation and Development Goals, and the criteria
prescribed by ORS 199.462 and 198.805, the affected area would be
benefitted by annexation to the District; and
WHEREAS, after consideration of the economic, demographic
and sociological trends and projections pertinent to the proposal,
past and prospective physical developments of the land that would
directly or indirectly be affected by the proposal, and all other
matters considered to be relevant to the petition, the Board is of
the opinion that the area would be benefitted by annexation to the
District; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, HEREBY ORDERS as follows:
1. The petition for annexation of territoryto the
Deschutes County Rural Fire Protection District No. 1 be approved.
2. That the boundaries of the territory to be annexed
to the District are as described in Exhibit A, attached hereto and
by this reference incorporated herein.
3. That the applicable land use criteria pertinent to
the proposed District annexation, the facts found by the Board, and
the reasons why the Board believes those facts to bring the proposal
within the requirements of the applicable land use criteria are
described in Exhibit B, attached hereto and by this reference
incorporated herein.
4. A final hearing regarding annexation to the District
shall be held on February 11, 1981, at 10:00 A. M. in Conference
Room A at the Deschutes County Courthouse Annex, Bend, Oregon.

5. All interested persons may appear and be heard.
6. Upon conclusion of the final hearing, the Board will
enter its final order creating the District unless written requests
for an election are filed at or before the hearing by resident
voters within the District numbering not less than 15% of the
registered voters, or 100 registered voters, whichever is the lesser
number.
7. This Order shall be personally served upon each non-
appearing owner of land within the area to be annexed.

1. A public hearing regarding the proposed annexation to the
the Deschutes County Rural Fire Protection District No. 1
will be held on Wednesday, January 21, 1981, at 10:00 A.M.
in Conference Room A at the Deschutes County Courthouse
Annex, Bend, Oregon.
2. The boundaries of the proposed annexation are:
The South Half of the Southeast Quarter (S2 SE4), and the
Northwest Quarter of the Southeast Quarter (NW4 SE4) of
Section Fourteen (14) EXCEPT those portions of the said
Northwest Quarter of the Southeast Quarter (NW4 SE-I,)
described as follows:
A parcel of land lying in the Northwest Quarter of the South-
east Quarter (NW-I, SE-1,) of Section Fourteen (14), Township
Fifteen (15) South, Range Twelve (12) East of the Willamette
Meridian, Deschutes County, Oregon, being described as follows:
Beginning at the Northeast corner of the Northwest Quarter
of the Southeast Quarter (NW-I, SE4) of said Section Fourteen
(14); said point also being 1309.8 feet West of the Quarter
corner on the East line of said Section Fourteen (14); thence
South along the line between the Northwest Quarter (W,-) and
the Northeast Quarter of said Southeast Quarter (NE4 SE4) a
distance of 518.8 feet to a point on the Northerly bank of
the Deschutes River; thence along the bank of said river as
follows: North 72° 12' West a distance of 83.9 feet; thence
North 48° 05' West a distance of 280.0 feet; thence North
1° 45' East a distance of 155.0 feet; thence North 24° 49'
East a distance of 166.5 feet to a point on the North line of

Northwest Quarter of the Southeast Quarter (NW,-, SE4) and
running thence East along the North line thereof, a distance
of 271.43 feet, more or less, to the Easterly right of way
line of the Tumalo-Cline Falls Market Road, as now located
over said premises, being the point of beginning; thence
East along said North line to the Westerly bank of the
Deschutes River, thence Southerly along said Westerly bank
of said river a distance of 260 feet; thence West on a line

feet to the high water mark on the Westerly side of the
Deschutes River, thence South 12° 59' East 310.70 feet; thence
South 87° 52' West 794.05 feet to the Easterly boundary line
of Cline Falls-Tumalo State Highway; thence North 04° 54'
East 113.10 feet along the Easterly boundary of the said
Cline Falls-Tumalo Highway to the point of curve right; thence
North 14° 51' East 202.95 feet; thence North 87° 52' East

FINDINGS
That the annexation will further the provision of
public facilities and services to the property by providing fire
protection services in accordance with LCDC Goal 11 because:
1. Fire protection is a basic rural service;
2. Reduces chances of multiple districts being
formed in the area; and
3. Is a condition precedent to additional rural
development.
