WHEREAS: 1. It appears from the survey of Howard Kraus, P.E., dated February 10, 1981, that the description of the property conveyed to the District by the Association of Unit Owners of the Inn of the Seventh Mountain by its deed dated September 17, 1980, was erroneous; 2. The said Association has passed a resolution authorizing the Chairman of its Board of Directors and the Secretary of the Association to convey to the District by warranty deed the same property properly described with a notation on the deed giving notice of the correction; and 3. This Board has instructed its attorney Louis B. Dvorak to record a quitclaim deed from the District to the Association of the mistakenly described property when he has taken delivery of the correction deed from the Association, and then to record said correction deed; NOW THEREFORE, IT IS HEREBY RESOLVED that pursuant to ORS 451.550(4), the Board of County Commissioners acting as the governing body of the Seventh Mountain County Service District shall, upon delivery of a proper warranty deed to the property upon which the District's waste water treatment facility is located, execute and deliver a quitclaim deed to the Association of Unit Owners of the Inn of the Seventh Mountain of the property which said Association conveyed to the District by its deed dated September 17, 1980. STATUTORY QUITCLAIM DEED The SEVENTH MOUNTAIN COUNTY SERVICE DISTRICT, a municipal corporation, Grantor, releases and quitclaims to the ASSOCIATION OF UNIT OWNERS OF THE INN OF THE SEVENTH MOUNTAIN, an unincorporated association, Grantee, all right, title and interest in and to the following described real property: A parcel of land which lies within the Southwest one-quarter of the Southeast one-quarter (SW14SE'x) of Section twenty-two (22), Township eighteen (18) South, Range eleven (11) East of the Willamette Meridian, Deschutes County, Oregon, more particularly described as follows: Beginning at a point which is 1331.03 feet North 890 59' 51" West; 1277.27 feet North 000 48' 58" East to the South right of way line of Century Drive; 245.95 feet North 740 43' 20" East along the South right of way line of Century Drive; 1084.31 feet South 890 40' 45" East; and 1346.46 feet South 890 49' 30" East of the South one-quarter corner of Section 22, Township 18 South, Range 11 East of the Willamette Meridian in Deschutes County, Oregon; and running thence South 000 19' 00" West 270.00 feet; thence North 890 49' 30" West 185.00 feet; thence North 000 19' 00" East 270.00 feet; thence South 890 49' 30" East 185.00 feet to the point of beginning.
