WHEREAS, Resolution No. 80-229 provided for a hearing for
the exchange of property between Deschutes County and the City of
Bend; and
WHEREAS, said hearing was held on January 28, 1981; and
WHEREAS, ORS 275.100 requires that the Board of County
Commissioners authorize the exchange of lands after hearing by order;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the properties described in Section 1 of
Resolution No.~ 229, a copy of which is marked Exhibit "A," attached
hereto and by this reference incorporated herein, are of equal value.
Section 2. That the exchange of such property is in the
best interest of the County.
Section 3. That the execution and delivery of the necessary
deeds of conveyance relating to the exchange of property authorized
by this Order is hereby ratified by the Board of County Commissioners.

RESOLUTION NO. 80-229
WHEREAS, ORS 275.100 provides that the Board of County
Commissioners declare its intention to exchange land with a municipal
corporation organized under the laws of the State of Oregon by proper
resolution; and
WHEREAS, a hearing shall be held for.;._.the purpose of receiving
objections to the proposed exchange of land; and
WHEREAS, Deschutes County, Oregon, intends to exchange
land with the City of Bend, Oregon; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That Deschutes County, Oregon, intends to
exchange the real property described as:
A possibility of reverter should the land cease
to be used for public purposes, in the property
described as:
A parcel of lard containing 0.007 acres, more
or less, located in a portion of Lot 10, Block
1, Plat of Deschutes, City of Bend, Deschutes
County, Oregon, being more particularly
described as follows:
Beginning at the Southwest corner of said Lot 10;
thence following the West lire of said Lot 10
North 00° 22' 49" West a distance of 42.13 feet;
thence following the arc of a 260.00 foot radius
curve right a distance of 8.42 feet (chord bears
North 50° 11' 04" East 8.42 feet); thence
following a line lying 6.50 feet East of and
parallel with the West line of said Lot 10 South
00° 22' 49" East a distance of 47.49 feet to the
South line of said Lot 10; thence following the
South line of said Lot 10 South 89° 43' 01" West
a distance of 6.50 feet to the Point of Beginning,
the terminus of this description, TOGETHER WITH
that portion of the alley in said Block 1 abutting
thereon, which inures to that portion of said lot
by vacation.

SUBJECT TO all easements, restrictions and
rights-of-way of record, and those common and
apparent on the land,
with the City of Bend, Oregon, for land described as:
A possibility of reverter should the land cease
to be used for public purposes, it the property
described as:
A parcel of land containing 0.16 acres, more or
less, located in a portion of Government Lot 1
of Section 6, Township 18 South, Range 12 East,
Willamette Meridian, City of Bend, Deschutes
County, Oregon, being more particularly described
as follows:
Beginning at the Northeast corner o£ Lot 4 of
Enterprise Acres; thence following the East line
of said Lot 4 (also being the West line of
Columbia Avenue) and the Southerly extension
thereof South 00° 02' 07" West (South record per
plat) a distance of 236.62 feet to a point on a
line lying 50.00 feet Southerly of (distance at
right angles) and parallel to the Southerly line
of said Enterprise Acres; thence following the
said parallel line South 84° 51' 16" West a
distance of 85.07 feet; thence North 28° 45' 59"
East a distance of 86.48 feet; thence following
the arc of a 350.45 foot radius curve left a
distance of 175.73 feet (chord bears North
14° 24' 03" East 173.90 feet) to the Point of
Beginning, the terminus of this description.
SUBJECT TO all easements, restrictions and
rights-of-way of record, and those common and
apparent on the land.

Section 3. That the Clerk of the County Court shall

The Bend Bulletin once each week for four consecutive weeks prior
to the date of such hearing.
