36-522-Order No. 80-243 Recorded 12/18/1980or 3 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,gREGON 0 L E An Order Vacating ) portions of Ninth Street, ) r c; 1 1980 Tenth Street, and Wharton ) Avenue, all within Laidlaw ROS ) DESCHU~ R C~UT?ERSp, ORDER NO. 80-243 NTY CLf,^FC This matter having come before the Commission on November 5, 1980, upon the petition of LaMoine Brant, Deschutes County, Oregon, requesting the vacation of portions of Ninth Street, Tenth Street, and Wharton Avenue, to-wit: All of that portion of Ninth Street, extending from the westerly right-of-way line of Riverview Drive to the northeasterly right- of-way of the Bend-Sisters Highway, and all that portion of Tenth Street extending from the westerly right-of-way of Riverview Drive to the northeasterly right-of-way of Bend-Sisters Highway, and all of that portion of Warton Avenue from the southerly right-of- way of Eight Street extending to the northeasterly right-of-way of the Bend-Sisters Highway, and all that portion of the alley in Block 40 north of the northeasterly righ-of-way of the Bend-Sisters Highway, in the plat of the townsite of Laidlaw, as recorded in the office of the County Clerk, Deschutes County, Oregon. That there is also on file and of record the certificate of Neil K. Hudson, Director of Public Works, for Deschutes County, swearing to the placing and posting of the-notice of the aforesaid vacation on three places within the limit of the area to be vacated, and one notice posted on the Bulletin Board at the Deschutes County Courthouse Annex. That the reasons have been set forth by the petitioner for the necessity of the vacation which has been petitioned, and it appearing to the Commission that the petition has been filed with the County Clerk for thirty days or more previous to the 17th day of December, 1980, and the Commission being fully advised in the premises. NOW THEREFORE IT IS HEREBY ORDERED that the above described public roads, (Portions Of) Ninth Street, Tenth Street,and Wharton shall be and the same is hereby vacated, as there were no objections at such hearing held.
