36-851-Resolution No. 81-001 Recorded 1/21/1981` - VOL BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Initiating Proceedings to Improve Certain Dedicated Public Roads Within the Howell Hilltop Acres Special Road District, Describing the Road to be Improved, Designating Where the Improvements Shall be Made, Defining the Nature of the Improve- ments, and Referring the Resolution to the County Engineer for Investiga- tion of the Proposed Improvements RESOLUTION NO. 81-001 F/1 c ✓qN 2� ROSE 1981 D�SCy� fs CyP 4 r,-% uNryN C(fpK WHEREAS, Howell Hilltop Acres Special Road District has requested that the Board of County Commissioners improve certain roads within the District; and WHEREAS, the Board of County Commissioners agreed to commence the improvement of certain roads within Howell Hilltop Acres Special Road District, provided the investigation and formation of any local improvement district entails no County expense that is not reimbursed; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES fCOUNTY, OREGON, as follows: Section 1. That proceedings to improve dedicated public roads described as certain roads within Howell Hilltop Acres Special Road District, which is described as follows: That portion of Section 7, Township 15 South, Range 13 East, and Section 12, Township 15 South, Range 12 East, of the Willamette Meridian,in Deschutes County, Oregon, described by the following included Subdivisions: Howell's Hilltop Acres; EXCEPTING THEREFROM, the Westerly 30 feet of the SE 4 of the NE 4f Section 12. Johnson Acres; and Parcels 1, 2 and 3 and the Northerly 30 feet of N.W. Kingwood Avenue further described as follows: Beginning at the Northwest corner of Section 7; thence South 00° 20' 46" West along the West line of Section 7, 30.00 feet to the Southerly right-of-way of N.W. Maple Avenue; thence South 89° 48' 40" East, along said Southerly right-of-way of N.W. Maple Avenue, 140.00 feet to the TRUE POINT OF BEGINNING; RESOLUTION NO. 81-001, PAGE 1 �. • • VOL ej6PbGE 52 Thence, continuing South 89° 48' 40" East along said Southerly right-of-way of N.W. Maple Avenue, 411.05 feet; Thence South 00° 20' 46" West, 424.28 feet; Thence North 89° 48' 40" West, 247.58 feet; Thence South 00° 20' 46" West, 463.03 feet; Thence South 89° 46' 46" East, 964.21 feet to the East line of the Northwest one-quarter of the Northwest one-quarter of said Section 7; Thence South 00° 34' 56" West, along the East line of the Northwest one-quarter of the Northwest one-quarter of said Section 7, 403.80 feet to the centerline of N.W. Kingwood Avenue; Thence North 89° 53' 11" West, along said centerline of N.W. Kingwood Avenue, 1126.15 feet; Thence North 00° 02' 46" East, 1293.12 feet to the TRUE POINT OF BEGINNING. The above-described Special Road District con- taining 176.5 acres gross, more or less, all lying in Deschutes County, Oregon. SUBJECT TO all easements and rights-of-way of record; be commenced. Section 2. That the dedicated roads to be improved within the area described in Section 1 of this Resolutions are described as follows: 47th Street 49th Street 50th Street 51st Street 53rd Street Kingwood Avenue Jackpine Avenue Hemlock Avenue Greenwood Avenue Elm Avenue and any roadways within the District not specifically included within the above listing. Section 3. The improvements to be made to the roadways within the District include, but are not limited to, the following: 1. Subgrade preparation to remove high points and depressions. RESOLUTION NO. 81-001, PAGE 2 VOL 316PAGE 85.3 2. Grading of existing cinder base material. 3. Placement of a leveling course on the prepared subgrade or graded cinder surface. 4. Compaction of subgrade, existing cinders, and leveling course. 5. Placement of a hard surface asphalt material over the prepared leveling course. 6. Installation of street and safety signs within the District boundaries. 7. Engineering, surveying, legal, interim, financing, administration in planning and construction of the proposed improvements, and other related costs. Section 4. All roads within the District to be improved as a result of this Resolution shall be improved to County road standards. Section 5. This Resolution shall hereby be referred to the County Engineer for investigation of the proposed improvements in accordance with ORS 371.625. The County Engineer may engage the services of any qualified engineer for all or part of the investiga- tion required under ORS 371.625, provided, that Howell Hilltop Acres Special Road District pays the entire cost of such engineering services.
