35-984-Order No. 80-202 Recorded 9/30/1980VOL 5 pn-r 984 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,OREGON An Order Determining the Effective) Date of Certain Building Permit ) Applications of La Moine Brant ) in Township Sixteen South, Range ) Twelve East of the Willamette ) Meridian, Section 31, Located ) in Deschutes County, Oregon ) ORDER NO. 80-202 WHEREAS, La Moine Brant appeared before the Board of County Commissioners of Deschutes County, Oregon, on September 16, 1980, and requested that the Board of County Commissioners determine, for certain building permit applications, whether the applications were made before November 1, 1979; and WHEREAS, the Board reviewed the County records relating to those certain building permit applications, interviewed staff regarding the sequence of events relating to said applications; and WHEREAS, La Moine Brant, upon advice of the Deschutes County Planning Department, had submitted information for a site plan review which was unnecessary; and WHEREAS, money, which was deposited for the site plan review procedure, would have covered a substantial portion of the building permit fees on at least one application; and WHEREAS, the Planning Department approved the building permit applications of La Moine Brant on November 1, 1979; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. That the building permits of La Moine Brant dated October 5, 1979, and approved by the Deschutes County Planning Department on November 1, 1979, be deemed to have been filed before November 1, 1979, subject to the conditions listed in Section 2 of this Order. Section 2. The conditions relating to the determination of the date of filing of the building permit applications of La Moine Brant are as follows: a. That approval and Building Brant within of the Deschutes County Official be requested by 30 days from the date of Sanitarian La Moine this Order. ORDER NO. 80-202, PAGE 1 f - . lot, 35 PACE 985 b. Road approach permits must be issued prior to issuance of any building permits. c. That there be no change in the type or configuration of the structures for which the applications are made. d. That there be no increase in the scope or valuation of the applications. e. That any building permit or permits issued as a consequence of this Order be valid for not more than 180 days from the date of approval by the Deschutes County Building Official. f. That rights under any permit issued to La Moine Brant not be transferred. Section 3. The applicant, La Moine Brant, is not required by the terms of this Order to proceed in any manner with construction of any structures for which the building permits have been deemed to have been filed prior to November 1, 1979. The applicant is hereby informed that any structure under the permits considered above, are non-conforming uses in the Rural Service Residential-M (RSR-M) zone. The applicant is further informed that the zoning on the property relating to these certain permits is zoned Rural Service Residential-M (RSR-M).
