This matter came before the regular term of the Board of County Commissioners
on February 28, 1980, on the request of Central Electric Cooperative, Inc., rep-
resented by C. Montee Kennedy, Esq. Based on the evidence, exhibits, appraisal
report, and advice of counsel received at that meeting, the Board of County Commissioners
finds as follows:
1. As a result of patent number 36-69-0064, recorded at Volume 165, Page 569
of Deeds, in the records of the Deschutes County Clerk, the County owns the North
Half of Section 14, Township 18 South, Range 12 East of the Willamette Meridian,
Deschutes County, Oregon.
2. Central Electric Cooperative, Inc., by the letter of its attorney,
C. Montee Kennedy, Esq. dated February 21, 1980, has offered to purchase the property
described below, containing six acres, more or less, for $14,100.00. The intended
use of this property will be for the storage of repair parts and parking for main-
tenance vehicles of the Cooperative. The effect of the Cooperative's use of the
property for this purpose will be to shorten the duration of power outages and the
saving of energy, in that in many cases repair crews would no longer have to be dis-
patched from Redmond to handle repairs and emergencies occurring in the Cooperative's
service area South and East of Bend.
3. ORS 275.090(2) provides that the County may sell lands received by gift,
and ORS 271.310(1) provides that County real property not needed for public use
may be sold to private persons.
4. The Board finds that the land described below is not needed for public
use and that it would be in the best interests of the County to sell the land
described below for cash.
5. Based on the opinion of the County Assessor, the Board finds that the
minimum acceptable bid for the property will be $2,350.00 per acre, and that the
purchaser shall be required to obtain a survey by a licensed land surveyor at his
own expense prior to the closing of the sale. The survey will determine the exact
acreage of the parcel. If the sale is consummated, the Board intends to allow
one-half the cost of this survey as a credit against the purchase price, by separate
orders if it finds the cost of the survey to be reasonable.
6. The Board intends to exercise its discretion in choosing the highest and
best bidder for cash under ORS 275.190, and to sell to the highest bidder that will
use the property as a facility for the support of the maintenance and repair of
electric utilities serving the area surrounding the parcel.

NOW, THEREFORE, IT IS HEREBY ORDERED that:
1. Pursuant to ORS 275.110, the Sheriff is directed to sell the following-
described property at the minimum price of $2,350.00 per acre, cash, purchaser
to provide a survey by a licensed land surveyor ascertaining the exact acreage of
the property at purchaser's own expense:
That portion of the South 1,000 feet of the West
Half, Southeast Quarter, Northwest Quarter, Section
14, Township 18 South, Range 12 East of the
Willamette Meridian, lying West of the Pacific Gas
Company transmission line right-of-way. This
property is a portion of Tax Lot 100, Assessor's
Map 18 12 14, containing six acres, more or less.
2. The Sheriff will advertise the sale pursuant to ORS 275.120.
3. In exercising its discretion to identify the highest and best bidder,
the Board will give preference to the high bidder that is ready and will.- *.o use
the land for a facility supporting the maintenance and repair, activities. of the
electric.utilities'serving the general area of-the parcel.
