A Reserve Strip on American ) O R D E R
Lane for Public Access )
This matter came before the regular term of the Board of County Commissioners
on the 4th day of June, 1980, at the request of the Roadmaster. The Board finds
as follows:
1. That a portion of American Lane in Reed Market Industrial Area Subdivision,
Plat No. 516, recorded as Plat No. 516 in the records of the Deschutes
County Clerk, there is a reserve strip as defined by Section 1.060(51)
contiguous to a public way which has been offered to the County for street
purposes and which offer has not heretobefore been accepted by the County
for reason that additional adjacent right-of-way had not been acquired by
the County. As a result, the access rights of the public were temporarily
abandoned until such time as the additional adjacent right-of-way was
acquired by the County.
2. The public has acquired right to use right-of-way contiguous to the sides
of said strip on American Lane, and it is now in the public interest to
accept said reserve strip as part of American Lane, a way of public
easement not part of the County road system.
3. The portions of American Lane on either side of the reserve strip and the
reserve strip itself have been dedicated as a public way pursuant to ORS
368.542(2).
NOW, THEREFORE, IT IS HEREBY ORDERED that:
1. The following described reserve strip is accepted pursuant to ORS 368.546(2)
and said reserve strip shall henceforth be open to public use and travel:
2. A copy of this order shall be sent to the County Surveyor, who shall annotate
the plat on which the reserve strip appears to show that it is now accepted
as a part of a public highway and road.
