BEFORE THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON

Applicant )
WHEREAS, the applicant received approval of CU-79-26 from the County Hearings Officer
and Planning Commission; and
WHEREAS, a de novo review was requested by Northwest Commercial, Inc. and granted
by the Board of County Commissioners for the purpose of considering a traffic study
not available at the earlier hearings; and
WHEREAS, the de novo review was held and the evidence considered,
NOW, THEREFORE, the Board of County Commissioners adopts the findings and conditions
adopted by the Planning Commission on November 14, 1979, and further finds as follows:
1. The Mountain View Mall development will substantially increase the
traffic load on Highways 97 and 20, as indicated in "Traffic Access
and Impact Study" submitted by appellant Northwest Commercial, Inc.
2. Those highways in their current design will be inadequate in the fore-
seeable future to safely accommodate access and overall usage demands
generated by major commercial developments in the Bend-Redmond
corridor.
3. The Board of County Commissioners intends to investigate and adopt
a policy which will guide future traffic patterns in the area.
4. C.E. John Company has indicated its willingness to cooperate in the
effectuation of whatever plan is adopted by the Board of Commissioners
to resolve the traffic problem.
NOW, THEREFORE, IT IS HEREBY ORDERED that CU-79-26 is approved, subject to the conditions
imposed by the Hearings Officer and the Planning Commission, and also subject to the
condition that C.E. John Company participate in the implementation of any legally
authorized policy as it pertains to commercial and industrial uses, developed by Deschutes
County in regard to traffic problems in the area of Highways 97 and 20 between the
Bend and Redmond urban growth boundaries.
