FOR DESCHUTES COUNTY
In the Matter of Plan Amendment) AMENDMENT TO COUNTY COMPRE-
Application No. PA-79-4 ) HENSIVE PLAN TO 1990
WHEREAS, CLAUDE POWELL has applied for a plan amendment of his
property described as follows:
Approximately 55 acres in Cimarron City, First Addition,
tax lots 100, 13200, 13800, 14300, 15000, 15300, 15400,14600,14700
16500, 16600, Section 16, T17S, R13E; and
WHEREAS, the application is for a plan amendment from Intensive
Agriculture to Residential.
WHEREAS, the Board adopts the findings attached hereto as
Exhibit "A", and incorporated herein by reference; and
WHEREAS, the application has been recommended for approval
by the County Hearings Officer following a public hearing
held December 11, 1979, continued to January 8, 1980;
and January 22, 1980;
NOW, THEREFORE, the Board of County Commissioners ordains
that the property described above be designated on the Com-
prehensive Plan to 1990 as residential.
This ordinance being necessary for the immediate preservation
of the public health, welfare and safety, an emergency is
declared to exist, and this ordinance shall take effect
upon its adoption.

BURDEN OF PROOF: In order to approve a plan amendment the
applicant must meet the conditions of
Section 6.000 of Deschutes County
Ordinance PL-9.
FINDINGS:
A. Subject Property:
1. Location:
The subject property is located in Cimarron City,
First Addition, and is further described as tax lots
100, 13200, 13800, 14300, 15000, 15300, 15400, 16500, 14600,14700,
16600 in Section 16, T17S, R13E of the Willamette
Meridian.
2. Zone:
A-1, Exclusive Agriculture.
3. Comprehensive Plan Designation:
Intensive Agriculture
4. Site Description:
Subject property is approximately 55 acres in size
and consists of 11 lots. The property is generally level
and is covered with sagebrush, juniper trees and
natural grasses. The property is outside the Bend
Urban Growth Boundary.
VICINITY INFORMATION:
To the south and west are generally single family
residences. Property to the north and east is
vacant. The property under consideration is within
the Cimarron City, First Addition subdivision.
CONCLUSIONS:
A. The Deschutes County Comprehensive Plan 1990 provides
that suburban residential development of parcels ranging
from one half acre to five acres in area should be
encouraged within the fringe of urban areas and dis-
couraged in rural areas. This property although outside
the Bend Urban Growth Boundary is in fact urbanized
as it is part of a planned and partially developed
subdivision. The development of these 11 lots will
not create any further spread of urbanization as
they are wholly contained within the boundaries of the
proposed subdivision.

Suburban residential areas are shown in all quadrants of
the community. Areas to the northeast, east, southeast,
and south are generally committed to suburban residential
densities because of the existing pattern, large lot
development in these areas and the pattern of land
ownership which makes it difficult to assemble land
for subdivision to urban residential lots.
Based upon the evidence presented at the hearings,
the staff report, the applicant's presentation and
the site visit by the Hearings Officer it is felt
that this zone change will simply allow the continued
development of this particular subdivision and will
not have a detrimental effect upon any agricultural
land in the community.
