34-907-Resolution Recorded 7/15/1980von ` 4 Pbi 907 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR DESCHUTES COUNTY In the Matter of Vacation ) of the County Roads Within ) RESOLUTION the City of Sisters ) (ORS 373.270) ) WHEREAS, the Board of County Commissioners finds as follows: 1. It is necessary, expedient and for the best interests of Deschutes County to surrender jurisdiction to the City of Sisters over all County roads within the corpor- ate limits of said city, since the County may not raise taxes to maintain and improve such roads to the standards of the City of Sisters, but the City of Sisters may do so under its Charter; 2. The Governing Body of the City of Sisters has requested that the County surrender jurisdiction pursuant to ORS 373.270 over the County roads located within the cor- porate limits of the City of Sisters, having found that it is necessary, expedient and for the best interests of the City of Sisters to acquire jurisdiction over said County roads to the same extent as it has jurisdiction over the other public streets and alleys of the City; NOW, THEREFORE, IT IS HEREBY RESOLVED that: 1. On the 20th day of August , 1980, at ten o'clock a.m. in Conference Room A of the Deschutes County Courthouse Annex, Bend, Oregon the Board of County Commissioners will hold a hearing pursuant to ORS 373.270(2) to consider any objections or testimony offered by any interested person to determine whether it is necessary, expedient, or for the best interests of the County to surrender jurisdiction over the County roads and highways located within the corporate limits of the City of Sisters described in Exhibit "A," attached hereto and incorporated herein by reference. 2. At said hearing, any interested person may appear, be heard and be represented by counsel. 3. If the Board of Commissioners determines that it is in the 'best interests of Deschutes County to do so, it will order vacation of all the County roads and high- ways described in said Exhibit "A" effective upon the legal adoption of an ordinance, resolution or other municipal legislation by the Governing Body of the City of Sisters, accepting the County's roads and highways described in said Exhibit "A" into its full, exclusive and absolute jurisdiction for purposes of repair, -1- .. .
