BEFORE THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON
FOR DESCHUTES COUNTY

of Highway and Road Funds on i ORDER
Southwest Tomahawk Avenue )
WHEREAS:
1. Southwest Tomahawk Avenue is a public road within the plat of Long Butte Tracts
recorded as Plat No. 402 in the records of the Deschutes County Clerk, and
2. ORS 368.551 provides that the County has the same jurisdiction power and authority
over a public way dedicated by deed or plat as it has over County roads, and may expend
highway and road funds on such public way upon making the findings of fact required by
ORS 368.551(2), and
3. The Board finds that (a) the County Roadmaster has recommended expenditure of
highway and road funds for the work on Southwest Tomahawk Avenue described below; and
(b) public use of Southwest Tomahawk Avenue justifies the improvements described below;
and (c) Southwest Tomahawk Avenue was dedicated to public use pursuant to ORS 368.546(2),
NOW, THEREFORE, IT IS HEREBY ORDERED that:
The County Roadmaster is directed to repair and fill with cinders those locations between
engineer's station 0+00 and 19+25, which in his opinion are low areas which would hold
surface water in wet weather and impair the passability of said road.
The Roadmaster may expend highway and road funds for this purpose.
