35-173-Order Recorded 8/21/1980DT THE BOARD OF COUN'T'Y CO~kffSSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of the ) determination of the ) "Effective Date" of ) Permit Applications and ) Permits ) O R D E R VU 35 FAGS. WHEREAS, from time to time amendments are legally made to the County Comprehensive Plan and Zoning and Subdivision Ordinances, the Oregon State Structural Specialty Code, and the State Health Department of Environmental Quality rules, and WHEREAS, the Board of County Commissioners finds it to be in the public interest to establish an "effective date" policy which will determine the regulatory structure to be applied to applications being processed, NOW, THEREFORE, IT IS HEREBY ORDERED that when amendments are made to the.County Comprehensive Plan and Zoning and, Subdivision and Partition Ordinances, the Oregon State Structural Specialty Code, and the State Health and Department of Environmental Quality rules, all applications reaching their "effective date" prior to the date and time of that amendment shall be processed under the ealier law, and all applications reaching their "effective date on or after that date and time shall be processed under and meet the amended law: and The "effective date" of a building Permit Application shall be the date and time that the Building Department assigns a Building Permit number, which shall only be done after the Planning Department approves the completed Permit Application, signs it and places their date on it, and after all related Sanitation, Planning, and Building fees are paid; and The "effective date" of a Building Permit (i.e. the date construction can begin) shall be the actual date of issue and signing of the Permit form by the Building Inspection Department after approval by the other jurisdictional agencies involved, i.e. Sanitation Department, and others required; and The "effective date" of a sanitation Permit Application shall be the date and tine on which the Sanitation Department receives a properly completed and submitted Permit Application, a completed plot plan and issues receipt for payment of all required fees ; and The "effective date" of a Sanitation Permit shall be the actual date of issue of the signed Permit form by the Sanitation Department after approval by the other juris- dictional agencies involved, i.e. Planning Department, and others required; and The "effective date" of a land use application under the County's Zoning Ordinance (PL-15) shall be the date and time on which an application is officially approved or denied. This shall be the date and time on which the formal decision is made in open public meeting by the appropriate hearings body, or in the case of administrative approval the date and time on which the permit is signed by the County Planning Director; and The "effective date" of a land use application under the County's Subdivision and Partition Ordinance (PL-14) shall be the date and time on 4dch an application is offica.lly given preliminary approval or denial in writing by the appropriate hearings body or other legally authorized person.
