33-812-Resolution Recorded 1/10/1980IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter of Hearing on Annexation to LaPine Rural Fire Protection District (Newberry Estates and Wild River Subdivision) BE IT HEREBY RESOLVED AS FOLLOWS: VOL 33 PacE 812 R E S O L U T I O N Section I. Pursuant to the provision of Oregon Revised Statutes, Chapter 198, a petition signed by the Board of Directors of LAPINE RURAL FIRE PROTECTION DISTRICT has been filed with the Deschutes County Board of Commissioners re- solving that proceedings to annex certain territory located in Deschutes County, Oregon, within the area described in "Exhibit A", attached hereto and incorporated herein by reference be initiated. Section II. On the 6th day of February, 1980 at 10:00 a.m. at the Deschutes County Courthouse Annex, Bend, Oregon, Conference Room A, a hearing will be held by the Deschutes County Commissioners for the purpose of receiving any protests to the proposed annexation by any interested persons. All interested persons may appear and be heard. Section III. The petitioners desire to annex said property to Rural Fire Protection District No. 2 for the following reasons: The proposed annexation will contribute to the orderly growth and development of both the district and the territory proposed to be annexed. Section IV. The Deschutes County Commissioners will cause to be posted this notice of said hearing in at least three public places and published by two insertions in a newspaper of general circulation within the area to be annexed. Section V. Approval of the Resolution for annexation by the Deschutes County Commissioners as presented or modified will result in an order being entered so declaring and fixing a place and time not less than 20 nor more than 50 days after the date of the order for a Final Hearing on the Resolution. The order shall declare that if written requests for an election are not filed in accordance with ORS 198.810 (2), the Commissioners may at the time of the Final Hearing enter their order author- izing the proposed annexation. (Newberry Estates and Wild River Subdivision) Newberry Estates: PARCEL I: The East one-half of the Northeast one-quarter of Section 31 and the West one-half of the Northwest one-quarter of Section 32, Township 21, Range 11. PARCEL II: The East one-half of the Southeast one-quarter of Section 31 and the West one-half of the Southwest one-quarter of Section 32, Township 21, Range 11. Wild River Subdivision: The Northeast Quarter of Section Twenty -Three (23) Township Twenty -One (21) South, Range Nine (9), East of the Willamette Meridian, Deschutes County, Oregon, including that portion thereof formerly platted as Pringle Falls Townsite EXCEPTING the following: (1) The South Half of the Southwest Quarter of the Northeast Quarter of Section 23, Township 21, South, Range 9, EWM. (2) That portion of the Southeast Quarter of the Northeast Quarter of said Section 23, Township 21, South, Range 9, EWM, bounded as follows: On the North by the South line of the "LaPine-Fall River Road;" on the East by the West bank of the Deschutes River; on the South by the South line of said Southeast Quarter, Northeast Quarter; on the West by the West line of said Southeast Quarter, Northeast Quarter. (3) The right of way of the "LaPine-Fall River Road." Begining at the inter- section of the Easterly bank of the Deschutes River with the North line of the Northeast Quarter; thence East along the North line of the Northeast Quarter 185 feet; thence South 200 feet; thence West to the Easterly bank of the Deschutes River; thence Northerly along the Easterly bank of the Deschutes River to the POINT OF BEGINNING.
