34-51-Resolution Recorded 2/6/1980IN THE BOARD OF COUNTY COMMISSIONERS OF THE STATE OF OREGON FOR DESCHUTES COUNTY In the Matter of Land Exchange, C. W. ) R E S O L U T I O N Reeve and Floyd Welch ) 14 WE 51 This matter came before the Board at the request of CLARENCE REEVE the owner of Block 1, lots 1-9 in Rio Land Subdivision, Deschutes County, Oregon on January 3 _, 19 80 . The Board finds as follows: 1. MR. REEVE, by his attorney, DANIEL E. VAN VACTOR, Esq., advised that due to regulations adopted by the Environmental Quality Commission that on Lots 3-9 of Block 1, Rio Land Subdivision, Deschutes County, Oregon, CLARENCE REEVE cannot obtain subsurface sewage disposal permits thereby effectively prohibiting construction of residences on said lots; and, 2. So as to be able to build on these lots, MR. REEVE wants to construct drainfields on certain County lands and pump the sewage from resi- dential buildings he plans on lots 3-9 into such drainfields through a pipe installed in the right-of-way of Sherrie Way, 3. Deschutes County is the owner of the certain partitioned lands described below as Parcel 1 and Parcel 2, such parcels being separated by the right-of-way of Sherrie Way in La Pine, 4. Parcel 2 is suitable for subsurface sewage disposal; and, 5. CLARENCE REEVE is the owner of the following described property: Lot 1 and Lot 2 in Block 1 of the plat of Rio Land, Subdivision, Deschutes County Oregon which land may be of equal or greater value for public use than Parcel 2 of the Deschutes County property; and, 6. It might be in the best interest of Deschutes County to exchange such lands if Parcel 1, which cannot be lawfully partitioned from Parcel 2 at this PAGE -1- RESOLUTION VOL 34 FAx 5 time, could be conveyed subject to a perpetual easement of public access and use as a park, 7. CLARENCE REEVE has expressed his willingness that Parcel 1 of the lands proposed to be changed remain permanently in public use for -park purposes; NOW, THEREFORE, IT IS HEREBY RESOLVED that the Board of County Com- missioners intends, pursuant to ORS 271.310(1), and 275.090, to exchange the following described lands of Deschutes County needed for public use: PARCEL 1: A tract of land located in the Northeast Quarter of the Northeast Quarter (NE4NE4) of Section Seventeen (17), Township Twenty-two (22) South, Range Ten (10), East of the Willamette Meridian, Deschutes County, Oregon and described as follows: Beginning at the Northwest corner of Lot Eleven (11), Block One (1) of the Plat of Rio Land Subdivision, Deschutes County, Oregon; thence South 450 feet to the Southwest corner of said Lot 11, Block 1, said point also being on the North right-of- way of Sherrie Way; thence West along the North right-of-way line of said Sherrie Way to the East line of Dorrance Meadow Road; thence North along the East right-of-way of said Dorrance Meadow Road to the center thread of the Little Des- chutes River; thence following the meander line of said river in a Northeasterly direction to a point which is Northerly of the point of beginning; thence South to the true point of beginning; reserving therein a permanent public easement for park purposes, PARCEL 2: A tract of land located in the NE -4 of the NE -4 of Section 17, Township 22 South, Range 10 East of the Willamette Meridian, Deschutes County, Oregon and described as follows: Beginning at the SE Corner of said NEI -4 of the NEI -4 of Section 17; thence South 89"29'28" west 588.07 feet to the easterly r/w of Dorrance Meadow Road; thence North 01'09' 23" west 10.10 feet; thence along the arc of a 620.70 foot radius curve to the right 176.87 feet, the chord of which bears North 7'00'58" East 176.27 feet; thence North 83'59'12" East along the southerly r/w of Sherrie Way 121.69 feet; thence along the arc of a 212.71 foot radius curve to .the deft 102.17 feet, the chord of which bears North 70' 17'07`." East 101.1.9. feet; thence North. 56'28'03" East 113.12 feet; thence along the arc of a 256.78 foot radius curve to the right 135.46 feet, the long chord of which bears North 71'29'32" East 133.89 feet; thence North 86'41'36" East 125.20 feet to the easterly line of said Section T7; thence leaving the southerly r/w of Sherrie Way, South 00''42'32" East 338.95 feet to the point of beginning. IT IS FURTHER HEREBY RESOLVED that: On March 11 , 1980 in Room A of the Deschutes County Courthouse Annex, Bend, Oregon at 10:00 a.m., the Board of County Commissioners will hold a public meeting pursuant to ORS 275.100 for the puv"pose of hearing objections to the proposed exchange of lands described above. At that meeting, any interested persons may appear, be heard and be represented by counsel. 2. A copy of this resolution shall be published in the Bend Bulletin once each week for four consecutive weeks prior to the date of the hearing. DATED this �A day of �• _, 1980.
