This matter came before the regular term of the Board of County Commissioners on
April 9, 1980, on the petition of Edward Fitch, attorney for the City of Redmond, a
municipal corporation. The Board of Commissioners being fully advised, finds as follows:
1. By the following deeds, the Board of County Commissioners has donated to the
City of Redmond, so Gong as it is used for public purposes, certain property lying
North of the present right-of-way of Airport Way in Township 15 South, Range 13 East of
the Willamette Meridian, Deschutes County, Oregon:
a. The Deed of October 31, 1977, recorded at Volume 262, Pages 353 through
355, Deeds, Deschutes County Records, corrected by the Deed of
January 10, 1980, recorded at Volume 317, Page 3, Deeds, Deschutes
County Records.
b. The Deed of May 7, 1975, recorded at Volume 221, Page 532, Deeds,
Deschutes County Records, corrected by Deed of October 23, 1979,
recorded at Volume 310, Page 85, Deeds, Deschutes County.Records.
2. The City of Redmond is willing to quitclaim the following-described property
to Deschutes County in return for a quit claim deed releasing the possibility of
reverter reserved in the above-mentioned Deeds, insofar as it applies to the property
lying North of the right-of-way of Airport Way:
A tract of land containing 3.17 acres, more or less, located
in the North Half (N2) of Section 26 and the North Half (N2) of
Section 27, Township 15 South, Range 13 East of the Willamette
Meridian, Deschutes County, Oregon, being more particularly
described as follows:
Beginning at the East quarter corner of said Section 27, thence.
following the East-West centerline of said Section 27, North
89° 47' 00" West, 5,300.10 feet, more or less; thence West follow-
ing the East-West centerline of Section 28, 1,427.00 feet, more
or less, thence on a line 1,250 feet southeasterly of and parallel
with the centerline of Redmond Municipal Airport Runway 4-22,
North 60° 31' 00" East, 3,474.66 feet to the "True Point of
Beginning" for this description; thence South 89° 47' 00" East,
3.712.00 feet, more or less; thence South 89° 51' 00" East, 2,396.07
feet, more or less; thence South 58° 33' 58" East, following a
line 1,250 feet southwesterly of and parallel with Redmond Municipal
Airport Runway 10-28, 47.55 feet, thence North 89° 47' 00" West,
6,187.33 feet to the said line parallel with Runway 4-22; thence
North 60° 31' 00" East following the said parallel line 44.10 feet
to the "True Point of Beginning" the terminus of this description,
SUBJECT TO all easements, restrictions and rights-df-way of record.

3. The possibility of reverter reserved in the Deeds mentioned above is not
needed for public use, in that it applies only to a narrow, unusable strip of land
abutting Airport Way containing approximately five acres, and it is in the public
interest to exchange the land described in paragraph 2 above for release of the
possibility of reverter.
4. The lands of the City of Redmond described in paragraph 2 above are of equal
or superior value to the possibility of reverter to be relinquished by the County.
5. ORS 271.310 authorizes this exchange.
6. The lands ordered to be quitclaimed herein which were not conveyed by the Deeds
mentioned above, have already been conveyed to the City of Redmond in fee by this
Board's Deed of April 5, 1979, recorded at Volume 303, Page 978, Deeds, Deschutes
County Records.
NOW, THEREFORE, IT IS HEREBY ORDERED that:
1. Upon receipt of a Deed properly quitclaiming to Deschutes County the real
property described in paragraph 2 above, the County will quitclaim the real property
described in Exhibit "A," attached hereto and incorporated herein by reference, to the
City of Redmond, a municipal corporation.
2. No engineering, surveying, appraisal, or other incidental costs will be paid
by Deschutes County in connection with this transaction.
3. The Deschutes County Counsel shall receive the deeds of conveyance involved
in this transaction and submit them to the County Clerk for recording upon payment of
the fee for recording the deed to the City of Redmond.

EXHIBIT "A"
A tract of land located in Sections Twenty-One (21) and Twenty-Two
(22), Township Fifteen (15) South, Range Thirteen (13) East,
Willamette Meridian, Deschutes County, Oregon, being more particularly
described as follows:
Beginning at a 3" Brass Cap marking the South one-quarter corner
of said Section 21; thence North 89° 28' 00" East, following the
South line of said Section 21, a distance of 662.76 feet to the
Southwest corner of the East one-half of the Southwest one-quarter
of the Southeast one-quarter of said Section 21; thence continuing
along said South line North 89° 28' 00" East a distance of 60.00 feet
to the "True Point of Beginning"; thence North 00° 05' 28" East along
a line 60.00 feet East of and parallel with West line of the East
one-half of the Southwest one-quarter of the Southeast one-quarter
of said Section 21,a distance of 2,329.06 feet; thence East a
distance of 2,982.67 feet to the Westerly right-of-way line of
Airport Way; thence following.said right-of-way line along the arc
of a 1,040.00 foot radius curve right 852.42 feet (chord bears
South 30° 34' 38" West 828.76 feet); thence South 54° 03' 28" West
along said right-of-way line a distance of 2,414.95 feet; thence
following the arc of a 1,040.00 foot radius curve right 642.72 feet
(chord bears South 71° 45' 44" West 632.45 feet) to the South line
of said Section 21; thence South 89° 28' 00" West following the South
line of said Section 21, a distance of 8.85 feet to the "True Point
of Beginning" the terminus of this description.
