O.B. Riley Road (Old D -C Hwy. ) RESOLUTION
Located East of U.S. Hwy. 97 )
in Bend, Oregon. )
This matter coming before the Board of County Commissioners
upon the petition of Ken A. Detroit, Bend, Oregon, Deschutes County,
requesting the vacation of'O.B. Riled Road (Old D -C Hwy.), located East of
U.S. Hwy. 97 in Bend, Oregon,.as described below:
And it further appearing that it is ,necessary to consider this
vacation for reasons of maintenance 'and acres-s;sand the Board of County
Commissioners feels'tbis.change should bO';,made`to serve the interests of all
land owners in'th4s area.
And it further appearing that this order is contingent upon the
petitioner granting easements to all, utilities now permitted by the County,
and the petitioner granting the County land of equal value to be used for
road purposes.
IT IS, THEREFORE, HEREBY RESOLVED that it is the intention of the
Board of County Commissioners to vacate the following described to -wit:
That portion of the 0. B.'Riley Road (the old Dalles-California
Highway) located in the SE 1/4 of Section 20, the SW 1/4 of
Section 21, the NW 1/4 of,Section,28"and the NE 1/4 of Section
29, T17S, R12E, W.M., Deschutes County, Oregon, lying northerly
of the northerly right-of-way line of the Swalley Canal and
easterly of easterly right-of-way line of U.S. Highway 97.
IT IS, THEREFORE, ORDERED that copies of this Resolution duly
certified to by the County Clerk, small be posted in three (3) places along
the road to be vacated, and that a copy of this Resolution be placed on the
bulletin board in the entrance of the Deschutes County Courthouse and
Courthouse Annex, Bend, Oregon; that December 6, 1978 at 10:00 a.m., in the
Courthouse Annex, Bend, Oregon, be and the same is hereby fixed as the time
and place for the hearing of objections, if any, why said portion of the
road should not be vacated.
