Chairman Young opened the meeting at 10:00 a.m. First on the agenda was
the opening of bids for Murphy Road. Lynn McKibben, Engineer in the
Road Department, opened the bids and read them. First was a group letter
from Colvin & Hoerning, Robert E. Meyer, N. W. Surveys, McCullough, Bryant,
& Associates saying that they were not bidding on this project since they
disagreed with the bidding process. Next bids were:
George Cook Engineering $ 29,500.00
Central Oregon Engineering- 38,000.00
Graves Surveying
Sun County Engineering 33,635.00
Apparent low bidder is George Cook Engineering, and after extensions are
checked the bid will be awarded. There was no actual engineer's estimate.
Next on the agenda was the continuation of the hearing on the establishment
of all of Volare Lane, Chuckanut, Springcrest Drive, Pam Place, Mahogany
Drive, Carm Lane, and Targee Drive, all of Romaine Village Unit 8 Subdivision.
Chairman Young re -read the order for the establishment of these roads and
reopened the hearing. Commissioner Grubb said the reason this hearing was
continued was that a number of the roads were not up to County standards
and the work had to all be done before they could be accepted. Charlie
Plummer, Roadmaster, said that he had been out Monday and all the roads
are now acceptable. Commissioner Montgomery made a motion to adopt the
orders to establish these roads. Commissioner Grubb seconded it. Vote
was unanimous.
Chairman Young referred back to the road bids then and said that he had
read an article in the Daily Journal of Commerce saying that all projects
should be advertised for bid, and since there is no other fair way to do
it we will continue with bidding.

Next Chairman Young moved on to discussion of the Road Department or
General Fund Bills. There was none, so we moved on to the next item.
Chairman Young moved on to the Ordinance Amendments of PL -5, the
zoning ordinance. The first amendment was Article 3. Section 3.355.
Chairman Young read the amendment in its entirety and then read the
title, which is required by law. Bill Monroe, Planning Director, explained
that this amendment relates to action taken by the Planning Commission,
and whatever is done will relate to the zone change request of Redmond
Roof Structures, which is on the agenda today. Mr. Monroe felt that we
were turning to much land from C-2 to M-1. Commissioner Grubb asked if
this isn't on a conditional use permit, and Commissioner Montgomery said
yes it was. Each case is treated individually that way. Commissioner
Montgomery suggested that we table this amendment and research it more.
Commissioner Montgomery then made a motion to table the amendment to PL -5
Article 3. Section 3.355 until the next Courtday, October 18. Commissioner
Young seconded it. Commissioner Montgomery voted aye; Chairman Young voted
aye, and Commissioner Grubb voted no. The amendment was tabled until the
next Courtday.
Chairman Young read the next amendment to PL -5, Article 3.640, in its
entirety and then read the title. Commissioner Grubb said he had checked
the portion that referred to 1 -acre minimums - Section 3.655, paragraph 3,
and felt that it should be amended to be 22 acre minimums for septic
tank approval. Commissioner Montgomery asked if the Sisters area had been
notified of this amendment and Bill Monroe said no. Commissioner Grubb
made a motion that we refer this Order to the city planning and the city
council for their recommendations. Commissioner Montgomery seconded it.
Vote was unanimous. Bill Monroe will see that this amendment goes to
the Sisters planning and city council.
Next on the agenda was the preliminary agreement of the Bend Urban Area
Comprehensive Plan. Chairman Young read a part of it and Commissioner
Montgomery made a motion for adoption of the agreement, with both City
and County approving this agreement. Commissioner Grubb seconded the
motion, and the vote was unanimous.
Chairman Young then moved on to the Planning Department Zone Change
Requests. First was the zone change request for David McKay from A -1-T,
exclusive agriculture with transitional standards to C-2, general commercial.
Chairman Young read the Order for the zone change request, and Commissioner
Grubb made a motion for adoption of this order, File Z-78-9. Commissioner
Montgomery seconded it. Vote was unanimous.
Chairman Young read the Order for zone change request by Babler Bros.
from A-1, exclusive agriculture to M-2, heavy industrial. Commissioner
Montgomery made a motion for adoption of this order, and Commissioner
Grubb seconded it. Vote was unanimous.

Chairman Young read the zone change request Order for Jeff Heath from A-1,
exclusive agriculture to SR -1, suburban residential. Commissioner
Montgomery said that looking at the dates on these requests, it appeared
that this was "house cleaning", and Bill Monroe answered that time has to
be allowed for appeals and this takes time. Commissioner Montgomery made
a motion for the adoption of this Order. Chairman Young seconded it, and
the vote was unanimous.
Next Chairman Young read the zone change request Order for Terry Mills
from A-1, exclusive agriculture to C-2, general commercial. Since a portion
of this was rezoned and had already been heard by the Board of Commissioners,
Commissioner Montgomery made a motion for the adoption of the Order.
Commissioner Grubb seconded it, and the vote was unanimous.
Next zone change request was by Bend Millwork from R-2, urban residential,
multi -family to M-1, light industrial. Chairman Young read the Order, and
it was stated that this is for the parking lot south of Bend Millwork.
Commissioner Montgomery made a motion for the adoption of this Order, and
Commissioner Grubb seconded it. Vote was unanimous.
Next zone change request was by Redmond Roof Structures. Chairman Young
explained that this request will be tabled along with that portion of
PL -5 that was tabled this meeting. Commissioner Grubb made a motion to
table this zone change request, Z-78-33. Commissioner Montgomery seconded
it, and the vote was unanimous.
Chairman Young read the zone change request Order by Donald Walker from
A-1, exclusive agriculture to R-1, single family residential and M-1,
light industrial. Commissioner Montgomery made a motion for adoption
of this Order. Commissioner Grubb seconded it, and the vote was unanimous.
Next zone change request was by Steve Palfy from A-1, exclusive agriculture
to SR -1, suburban residential. Chairman Young read the Order. Commissioner
Grubb made a motion to adopt this Order, Z-28-40; Commissioner Montgomery
said that he owned land about one mile from this area and he wanted it on
the record that he abstained from voting on this. Chairman Young seconded
the motion. Chairman Young and Commissioner Grubb voted aye, and
Commissioner Montgomery abstained. Zone change request was passed.
Chairman Young read the zone change request Order for Manuel Stoll from
SR -1, suburban residential to R-1, urban residential, single family.
Commissioner Montgomery made a motion for adoption of this Order, Z-78-42.
Commissioner Grubb seconded it, and the vote was unanimous.

Chairman Young read the Order for zone change request by Brookside
Properties from A-1, exclusive agriculture to R-1, single famlily
residential and SR -1, suburban residential. Commissioner Montgomery
made a motion for adoption of this Order, Z-78-43, and Commissioner Grubb
seconded it. Vote was unanimous. R-1 zoning was for the mobile homes, and
SR -1 was for the 1/2 acre lots.
Next zone change request was by Arthur Teater from A-1, exclusive
agriculture to R-1, single family residential, planned development.
Chairman Young read the Order and said this property is approximately
21 acres adjacent to the City of Redmond. Commissioner Montgomery made a
motion for adoption of the Order. Commissioner Grubb seconded it, and the
vote was unanimous.
Chairman Young read the Order for zone change request by Layton & Amundson
from A-1, exclusive agriculture to M-1, light industrial. Commissioner
Montgomery made a motion for adoption of this Order, Z-78-46, and Commissioner
Grubb seconded it. Vote was unanimous.
Next zone change request was by Brooks Resources Corp. from A -1-T, exclusive
agriculture with transitional standards to PD, planned development.
Chairman Young read the Order, and Commissioner Grubb made a motion to
adopt this Order, Z-78-49, subject to any farm deferral action. Commissioner
Montgomery seconded it, and the vote was unanimous.
Chairman Young read the zone change request Order for Fred Conley from
A-1, exclusive agriculture, to SR -1, suburban residential. Commissioner
Montgomery made a motion to adopt this Order, Z-78-54, and Commissioner
Grubb seconded it. Vote was unanimous.
Next on the agenda was discussion from those present. Duke Warner, Realtor
said there are 160 acres of land that is a separate tax lot on paved road
under farm deferral. There is no problem about the sale; however, the
buyer wants a release of 10 acres so that he can use it for security for
financing. The Planning Department says that he cannot do that as it is
partitioning and can't be done. Mr. Warner said that this would create
another tax lot but will not divide the property and will be kept in farm
deferral. Commissioner Grubb explained that according to LCDC if you have
to go through the partitioning procedures, it cannot be done. There are
some exceptions but we do not know what they would be. This is the
fallacy in the LCDC Order. Commissioner Montgomery recommended that Mr.
Warner see Brent Lake and get his opinion since he is with LCDC.
There being no further business this Courtday, meeting recessed at 11:05 a.m.
