Duke Warner, Realtor said there are 160 acres of land that is a separate tax lot on paved road under farm deferral. There is no problem about the sale; however, the buyer wants a release of 10 acres so that he can use it for security for financing. The Planning Department says that he cannot do that as it is partitioning and can't be done. Mr. Warner said that this would create another tax lot but will not divide the property and will be kept in farm deferral. Commissioner Grubb explained that according to LCDC if you have to go through the partitioning procedures, it cannot be done. There are some exceptions but we do not know what they would be. This is the fallacy in the LCDC Order. Commissioner Montgomery recommended that Mr. Warner see Brent Lake and get his opinion since he is with LCDC.
