29-147-Order Recorded 10/4/1978VOL 29 FACE 14 7 ` IN THE BOARD OF COUNTY COMMISSIONERS IN THE STATE OF OREGON FOR THE COUNTY OF DESCHUTES In the Matter ) of File No. Z-78-17 ) Zone Change Request by Oakley & ) 0 R D E R Gisler, from A-1, Exclusive ) Agriculture to SR-1, Suburban ) Residential ) This matter coming before the Board of County Commissioners upon the Hearings Officer's recommendations, who held a public hearing on this issue, May 30, 1978, and recommended approval, And it further appearing to the Board upon reviewing the Hearings Officer record in the matter that the following findings of fact were established: 1. The Bend Area General Plan designates the site within a Development Alternative Area to be developed to urban standard residential densities if community services are available, primarily water and sewer. The applicant could request lots as small as 14,000 square feet with the sewer service, this site being outside the Sewer Facilities Planning Area, and still be consistent with the SR-1 designation. 2. The proposed site is situated on ground which is not now being used, nor has it ever been used, for agricultural production. Consequently, there would not appear to be any conflict with Goal #3 dealing with agriculture. 3. The applicant satisfactorily addressed himself to the existence of public need for the rezoning and that this need would best be served by developing this property as compared with other available property. The fact that the surrounding subdivisions, each with a 22 acre minimum, have been sold out is sufficient to establish the existence of the need and because of its immediate proximity and contiguousness this proposed property is best suited for the purposes designed, as compared with other available property. The County deeming this action to be in the public interest, IT IS HEREBY ORDERED that the zoning of the following described property be changed from A-1 to SR-1, as shown on the attached map: VOL 29 PACE 148 k Page 2. File No. Z-78-17 East side of Old Deschutes Road and South of Pilot Butte Canal, North of Bend, or more specifically, a portion of SE4 of Section 15, T17S, RUE, on approx. 31 acres.
